Time to head to the attorneys

Obviously I am dismayed that the management would write me up for capturing&posting over the air communications. I have no choice but comply but now i actually have something in wrtiting that i can show an employment law attorney.
Can i beat them in a court of law? Who knows, given the recent ruling by the labor board it might be possible.
That will be for a qualified attorney to find out.
Robert Romo has assured me that everything that is currently posted on the blog will not subject me to any retroactive discipline so the current blog will not be wiped out which had been past practice.
I have been informed that i am violating HR202 when i post dispatch calls without getting permission from all persons involved in the call!

I had no problem with Trimet regulating my on the job behavior, such as no filming when driving, no taking pictures of employees/passengers with out permission etc.
But they are currently trying to stop me from completely lawful behavior OFF THE JOB!
And that is NOT LEGALLY ENFORCEABLE!

It's possible that people don't understand the definition of safety, let's elaborate:


–noun, plural -ties.

the quality of averting or not causing injury, danger, or loss.
3.
a contrivance or device to prevent injury or avert danger.

Should we contact US NEWS AND WORLD REPORT and have them interview our management?

But US News and World Reports has just examined the factual data and ranks Portland #1 City, in the ENTIRE US of A!
And part of that rating is number of safety incidents per million trips!

Could our general manager be wrong about our "culture of safety?"
I have been saying all along that there was nothing wrong with our culture!
And now it appears that I have been proven right by none other than US NEWS AND WORLD REPORTS!
Is it possible that a minor blogger could know more about the culture of  Trimet than a guy who has worked in capital projects for 2 decades?
Nah, can't be possible right?
I only made $35k last year.
Neil Mcfarlane made $240k, thats more than 10 times what I made.
He must know 10 times as much stuff about Trimet than me right?

    Feds settle case of woman fired over Facebook site

    TRIMET MANAGEMENT-PAY HEED TO THIS!

    WASHINGTON – Employers should think twice before trying to restrict workers from talking about their jobs on Facebook or other social media.
    That's the message the government sent on Monday as it settled a closely watched lawsuit against a Connecticut ambulance company that fired an employee after she went on Facebook to criticize her boss.
    The National Labor Relations Board sued the company last year, arguing the worker's negative comments were protected speech under federal labor laws. The company claimed it fired the emergency medical technician because of complaints about her work.
    Under the settlement with the labor board, American Medical Response of Connecticut Inc. agreed to change its blogging and Internet policy that barred workers from disparaging the company or its supervisors. The company also will revise another policy that prohibited employees from depicting the company in any way over the Internet without permission.
    Both policies interfered with longstanding legal protections that allow workers to discuss wages, hours and working conditions with co-workers, the board said.
    "I think it certainly sends a message about what the NLRB views the law to be," said Jonathan Kreisberg, the NLRB regional director in Hartford who approved the settlement.
    "The fact that they agreed to revise their rules so that they're not so overly restrictive of the rights of employees to discuss their terms and conditions with others and with their fellow employees is the most significant thing that comes out of this," Kreisberg said.
    Terms of a private settlement agreement between the employee, Dawnmarie Souza, and the company were not disclosed, but Kreisberg said the parties reached a financial settlement. Souza will not be returning to work there.
    Souza declined a request for comment. A representative for American Medical Response did not immediately return a call seeking comment.
    Souza posted the Facebook comments in 2009 from her home computer, hours after her supervisor said a customer had complained about her work. The expletive-filled posting referred to her supervisor using the company's code for a psychiatric patient. Her remarks at the time drew supportive posts from colleagues.
    Chuck Cohen, a labor and employment lawyer and former NLRB member during the Clinton administration, said the case will have employers around the country re-examining their Internet policies
    "It clearly has resonance because we know the NLRB's general counsel is going to take this position," Cohen said.
    But Cohen warned that the case doesn't give employees free rein to discuss anything work-related on social media.
    "The line can go over to disloyalty or disclosure of truly confidential information," Cohen said. "This is not without boundaries, but we just don't have a good sense yet of where the boundaries are."
    Millions of Americans use Facebook, Twitter and other social media. Kreisberg said the board is looking at a growing number of complaints that explore the limits of corporate Internet policies. The board is an independent agency that supervises union elections, referees labor-management disputes and works to prevent unfair labor practices in the private sector.
    Sara Begley, a Philadelphia-based employment lawyer, says image-conscious companies may be taken by surprise that the law protecting employees who want to discuss working conditions extends to social media sites, which can potentially be viewed by thousands or even millions of people.
    "I think it's a natural evolution that the law is being broadly interpreted to include social media considering that it's become one of the most prevalent methods of communication," she said.

    The following is an editorial by Erik Halstead regarding the accident that operator Nations was involved with that has now cost him a very long suspension:

    TriMet Operator was proceeding legally on S.W. 6th, had to make a left turn. Operator determined he could not safely make the turn from the left lane due to the size of the vehicle, and thus used (without conflict to other vehicles, which would simply be other TriMet vehicles in this case as the center lane is a restricted lane).
    Had the Operator not used both lanes, he would have climbed onto the sidewalk putting pedestrians at grave risk due to the size of the vehicle and/or collided with a stopped light rail train on Morrison. Further, there are no prohibitions on left turns by oversized vehicles at this intersection.
    At the end of the day, it was not the actions of the Operator that caused the collision. Given the choice of two evils, he chose the evil that would have prevented possible injury to pedestrians standing on the street corner waiting for the walk signal that could have been clipped by the size of the vehicle. It was the actions of a bicyclist who disobeyed a traffic control device and failed to yield right-of-way to the bus which was proceeding legally through the intersection that caused the collision.
    Ultimately, this is just another example of TriMet Management making boneheaded decisions to route buses on short notice without thinking about their actions, and using low level Operators as the fall guy instead of the General Manager owning up to the routing being the issue. In Germany, for example, every Autobahn has pre-determined, and permanently signed, detour routes in the event of an Autobahn closure. If the Autobahn is closed, you simply use the next exit and follow permanently installed signs that route you to the next on-ramp. If that ramp is closed, you keep following the detours. TriMet ought to have pre-determined detour routes for each bus route and MAX shuttle, including designated safe turn locations. It's not that difficult to do. TriMet Operators should not be the fall guy because some Supervisor didn't do their job correctly.

    FURTHER CLARIFICATION OF TRIME'TS CONTRACT POSITION

    On February 2, 2011, TriMet and the Amalgamated Transit Union, Division 757 (“ATU”) completed a second day of mediation without reaching an agreement. During mediation, many proposals were made and certain elements of those proposals were accepted, rejected and/or changed.  Receiving proposals and counter-proposals is helpful because it both narrows issues and helps clarify the “gap” between the respective parties It is also a challenge because each element that is introduced or changed has a cost impact that must be assessed.
    Although we have not successfully resolved our differences, we want to outline the elements of what TriMet believes was the best proposal offered to the ATU. With this failure to reach a settlement, the contract remains the same as it is today, with union employees paying the increased costs of benefits and no COLA.
    TriMet began the mediation asking about the possibility of a short-term or “bridge” agreement that would get us to the end of the year and an agreed upon schedule for further negotiation.  This short term approach was proposed as a way to avoid further service cuts and layoffs in the coming fiscal year and to outline an orderly process for entering into a longer term agreement.
    Below, I have listed the key elements of what I believed to be our best and reasonable short-term agreement.   It was proposed that the changes would be effective immediately after contract ratification by the ATU and approval by the TriMet Board.  We were confident that this could have been done in February.  Even with TriMet’s priority to avoid service cuts and layoffs, the proposal we offered did not achieve the full savings necessary, nor did it meet the Board’s objective of financial sustainability.  However, we felt that reaching a bridge agreement was in the best interest of all concerned and would be just enough to help us avoid service cuts and layoffs.
    Summary of TriMet’s Best Offer to ATU
    Term -   The agreement would expire on December 31, 2011
    Health Insurance- There would be two health care plans - Kaiser and Regence
    Deductible – There would be no deductible for either Regence or Kaiser
    Monthly Insurance Premium Payment Paid
    Active Employees: 2% monthly premium contribution for Regence only (effective immediately upon ATU ratification and TriMet Board approval; no monthly premium contribution for Kaiser.
    Retired Employees: No monthly premium contribution for Kaiser.
    Co-pays
    Regence: $15 for office visit. RX - $5 generic, $15 formulary brands, $25 non-formulary brands
    Kaiser: $10 for office visit. RX - No change to $5 co-pay
    Emergency Room - $50 co-pay for both Regence and Kaiser
    Wage Increase – There would be no COLA in 2011.  (Union employees received 3% COLA in June 2010.)  Wages would be frozen in 2011.
    Back Premium Payment for Pre-65 Retirees – TriMet would reimburse all pre-65 retirees for up to two months of their actual premium contributions upon ratification of the agreement.   
    Pending Unfair Labor Practices (ULP) – Pending ULPs would be withdrawn.
    New Contract & Binding Arbitration - Negotiations for a new contract between TriMet and the ATU would commence March 1, 2011. If the parties were not able to reach agreement before August 1, 2011, mediation would commence.  If the parties are not able to reach agreement during mediation, then binding arbitration would commence in November 2011.

    Good Faith Cooperation - The ATU would encourage all members to submit any required open enrollment forms in a timely manner.  TriMet’s open enrollment would be streamlined.  Employees that are currently in Regence or Kaiser (and their dependents) would remain in Regence or Kaiser, at the premium contribution levels stated above, unless they return a signed open enrollment form with a different election. The target date for implementing the new plans was May 1, 2011.

    He clearly states the growing Trimet and holding on to managers is far more important than giving his employees decent health care.

    NEGOTIATIONS

     THE UNION SIDE
    Once again, Neil McFarlane' description of negotiations last Friday and yesterday was "fiction" as usual. TriMet's position is the same as it has been: “take-away after take-away." One thing he didn't write about is what time talks ended last Friday. Since TriMet management doesn't work past five o'clock, that is when they ended talks. Goes to show how important employees are to TriMet, doesn't it?
     It’s clear that TriMet is not getting it. I encourage all of you to show up at the next Board of Directors’ meeting February 23rd, and please keep an eye on upcoming Tracking Fasters, our website, and follow us on Facebook as we will be looking for opportunities to visit the homes of TriMet management, and the Board of Directors. As we’ve stated before, we will use every legal method available to us in order to put pressure on TriMet’s illegal implementation of health insurance and send a strong message that without a good working relationship and somebody that understands labor management this system will not run smoothly.

    MCFARLANES SIDE: 
    I wanted to let you know our attempt to mediate our contract dispute with the ATU failed. We will share with you more details of our offers to settle soon. I believe our offers were fair and showed great flexibility in addressing specific issues. Last Friday, we began negotiations asking about a short term ‘bridge’ agreement – just to the end of this calendar year – together with a defined schedule for negotiation/mediation/arbitration of a follow-on agreement. The ATU offered back a two year agreement – but that required us to deal with some tough issues on retirement health care. Ultimately, that ‘track’ was dropped to work on an agreement just through this year’s end. We exchanged a number of proposals, but in the end could not reach an agreement. In the context of our short-term bridge agreement, our financial 'compass' was to seek an agreement that simply avoided service cuts and layoffs in the next fiscal year. Frankly, our best offer Wednesday did not even meet that standard and would have required us to push off essential capital and make deeper management cuts to keep our service at current levels. We have indicated to the state conciliator our willingness to continue conversations with the ATU. I am disappointed, but will continue to work hard to achieve a fair agreement. Neil

    Saturday February 5th and Saturday February 12th

    Dear AL OPAL's Bus Riders Unite, our Board and Community Organizers are getting out into the community to talk with Transit Riders the next two Saturdays February 5th and February 12th to build support for our Campaign for a Fair Transfer.  This is a meaningful way you can make a difference in our community, work for transit justice and health, and have a lot of fun with other folks who care about environmental justice.
    What is the plan?  We ask everyone to meet us at the OPAL Office 2407 SE 49th Ave (at Division, Bus #4, 14, 71) by 11:00 AM.  Come early and have coffee and light breakfast with us if you like.  At 11:00 AM we will have an orientation to how we do our outreach, and then we'll head out to talk with transit riders across East Portland.  We'll meet back up at OPAL at 2:30 PM for a debrief and late lunch.
    We'll be talking with transit riders about the impact of the 100,000 hours of service cuts and 10th fare increase in 10 years on their total transit experience, and sharing our community-driven solution to urge TriMet to support Bus Riders Unite! Campaign for a Fair Transfer.  All are invited to our Monday February 21st Campaign Kickoff at St Francis Parish on 11th and SE Oak.

    What is the Campaign for a Fair Transfer?  Working for environmental justice in public transportation.  Our platform:
    1.  Extend the Transfer Time to Three Hours.  This will:
    ▶  Equalize transfer time for both bus and MAX, during both weekdays and weekends, to 3 hours, providing riders more time to use transit for basic needs.
    ▶  Lessen the burden on transit-dependent communities. After yet another fare increase and over 170,000 hours of service being cut, those who depend on the bus to meet their needs aren’t getting what they’re paying for.
    2. Provide Unlimited Transfer Time after 7pm.  This will:
    ▶  Support night riders who use those lines that have been cut during off-peak hours, it takes people even longer to get home from work.
    ▶  Give riders the respect they deserve. Riders boarding after 6pm require unlimited transfers through the end of that day’s service because it will ease the tension brought on by already being disproportionately impacted by the lack of service at night.

    The woman caught beneath a Yellow Line MAX train Friday night as it was leaving the TriMet station at Northwest Sixth Avenue and Davis Street has died, TriMet reported Saturday morning.

    Officials are not releasing her name pending notification of family.

    The woman slid beneath the northbound train about 9:20 p.m. Friday after her cane made contact with the train as it pulled into the station, throwing her off balance, TriMet said. She reportedly fell between the two ends of of the train's cars.

    Portland Fire & Rescue responded, extricated the woman and transported her to OHSU Hospital.

    We have just learned that TriMet is requesting Union members in various positions to sign confidentiality agreements that could result in termination. The Union suggests that you sign this agreement and put "under protest" in parenthesis after your name. Please send a copy of this to the Union office. This is a change to the status quo and therefore we have sent a demand to bargain notice to TriMet.
