MESS AT ATU 757

It appears that Jon has been flexing his muscle again, this time replacing the step 3 ATU representative Khris Alexander with his brother Jeff. Although his brother Jeff is a very  personable man he works in maintenance and is not very familiar with operator issues.

Obviously using family members in various appointed positions does not give the impression of "transparency".

Reliable sources have informed me that Mr Alexander was replaced because he had lost his enthusiasm for the picketing and various demonstrations. He wanted to concentrate on his regular elected duties.
I've been questioning the effectiveness of the picketing myself.

There has been an issue with people showing up at their step 3 hearings. If you don't show up to defend your case you are risking a successful appeal.

One of the rail maintenance reps has not spent a full week working at Trimet for the last year due to union business. How much union business is there that it would take an employee off their regular jobs for a whole year?

The union won't pay for Rose Jordan to attend the national black caucus meeting?

ATU 757 policy of not accepting emails "due to cyber attacks" is very questionable. The entire world accepts emails as documentary evidence  of official communications but our union doesn't? Seems pretty simple to verify the sender of emails to me. Of course it makes it harder to conduct business when that business refuses to enter into the modern world.

Will ATU757 Drop The Ball?

Update 03/20/2011:
                I was advised by Sandy that Center Street posted the charges 03/19/2011 so it looks like everything is a go. So now the next step is to get 60% membership approval so a Trial Committee can hear the evidance and make a ruling. Things are finally moving forward.

                To assure that all members are treated equally I must point this information out. In preferring of charges our Constitution states “At least fifteen (15) days before the regular meeting of the L.U. or J.C., a copy of such charges shall be served upon the officer or member against whom such charges are filed and the L.U. or J.C. The L.U. or J.C. shall contemporaneously provide notice to all members that such charges are to be considered at the meeting by posting at appropriate locations.”

Contemporaneously - existing at or occurring in the same period of time.

                What this means is that the accuser must file at least 15 days before the charter meeting it will be presented at. The member being accused must receive a copy at least 15 days before the charter meeting and the membership must be notified about the consideration of such charges by being posted at appropriate locations.

                Our next charter meeting starts April 4th, 2011. Fifteen (15) calendar days would make Sunday March 20th, 2011 the last possible day to meet this requirement. Currently I have not seen any postings about this at Center Street Garage area. Today was the first I noticed the posting online. Only posting online is not assuring that all members have access to the information. This must be posted on all ATU757 union boards.

                Failure to do this is not fair to Sister Ellen Fox, Our membership or me. This filing was submitted to the union February 22nd, 2011. My last communications to Brother Jon Hunt about assuring this to be able to be presented in April’s charter meeting was on March 11th, 2011. I have given more than ample time for our local to advise the membership and Sister Ellen Fox. If any of our union boards do not have notice of this action posted by March 20th, 2011 our local has dropped the ball on all of us and would be in violation of our Constitution. If you do not see a notice on your union board before March 20th please let our local office, a union officer, Sister Ellen Fox or I know about this. Our Constitution is in place to protect all of us equally so please help us make sure this is all done correctly. –Thank you for your time on this Chris Day-

Is ATU757 Violating section 13.17?

                Our Constitution on page 60 section 13.17 states “A L.U. (local union) willfully violating the Constitution or principles of the A.T.U. or acting in antagonism to its welfare, may be suspended by the I.P. (International President) with the consent of the G.E.B. (General Executive Board), or may be placed in trusteeship in accordance with the provisions of Section 12.6.”
                Our ATU757 President Jonathan Hunt’s actions have been very questionable and I present to you the question of, should we take action? If we take action it will require presenting international with documentation that supports the violation of section 13.17. I submit to you some of the reasons and facts I have to move this action forward:
1.       In January of 2010 a preferring of charges was filed on Khris Alexander. This filing was submitted with at least the minimum required signatures. From communications with Khris Alexander and all the documents I have located on this filing I find that no signatures had been released to him or the membership. This is being handled different on my preferring of charges. President Hunt released the signatures allowing the list to be submitted to the employer. Signers of the filing had been questioned and intimidated for signing the filing by the employer, the member being accused and President Hunt. President Hunt states in an email “is my understanding the signatures make the charges so I sent her all of it”. Handling the two filings different is violating the principles of the A.T.U. in regards to assuring all members have equal rights and protections.
2.       President Hunt mailed out a letter to six (6) members. This letter was misleading and the facts were not correct. The purpose of the letter was to deny a member their constitutional right to present the filing to the membership.
3.       Allowing a list of members to be submitted to the employer is a violation of our Constitution section 21.7.

This is just a few examples of President Hunt’s willful acts that I have documentation on. There is more that can be presented. His latest actions leave room to question the security of our local union. The other officers have not taken any actions to stop him and that is why I question our members about bringing this to the International. I am working on the letter to mail to international and would like to get feedback from our membership about this. Talkie Review

I caught one of the prototype "talkie" buses today. I rode the 15 from SE Morrison & 7th to NW 23rd & Irving. Here's what I found:

- 2 cases the announcement was made during a non-turn (ex: pulling out from a bus stop)

- 1 case the bus entered the crosswalk at the "Ped" in "Pedestrians, the bus is turning."

- 1 case the bus entered the crosswalk at "the"

- 1 case the warning activated while the bus was totally stopped at a red light! (I guess the driver turned the wheel in preparation for a right turn?)

You can clearly hear the notice from inside the bus. I guess I wouldn't call this system annoying, just useless -- since generally speaking you won't hear the notice (much less have time to react) until the bus is already past the intersection.

The rumor is that officers laughed about it and dismissed it.

At this time the filing has not been acknowledged or responded to.

The sponsor is still waiting for official action to be taken.

AMERICANS FINALLY STARTING TO WAKE UP

Labor protests are continuing across the country. In South Carolina, thousands of teachers, religious leaders and state workers gathered at the capitol building on Sunday in opposition to cuts targeted at education, healthcare and other state services. In Austin, Texas more than 10,000 protesters swarmed the grounds of the capitol Saturday to denounce Gov. Rick Perry’s proposal to fire educators, increase class sizes and cut programs. On Friday, protesters in Maine filled the capitol building to take a stand against Gov. Paul LePage’s plan to strip $18 million from the state’s Fund for a Healthy Maine. Also on Friday, concerned parents and citizens in Maryland’s Prince George’s County gathered at a local school to protest budget cuts that could leave hundreds of low-income, magnet high school students without school buses. Meanwhile, protests in response Michigan Gov. Rick Snyder’s plan to tax the public and private pensions of senior citizens are scheduled for Tuesday in Lansing.

As we accurately reported earlier today, the explosion at the Fukushima nuclear plant in Japan was the result of a nuclear meltdown of the reactor core at the facility.
The Nuclear and Industrial Safety Agency (NISA) confirmed the meltdown [2] Saturday afternoon. Fukushima is one of the 25 largest nuclear power stations in the world. The NISA is affiliated with the Ministry of Economy, Trade and Industry.
High levels of cesium and iodine, by-products of nuclear fission, are being reported and providing more evidence that a nuclear meltdown is currently underway.
It is now certain Japan is experiencing a Chernobyl event. “At this point, events in Japan bear many similarities to the 1986 Chernobyl disaster. Reports indicate that up to 1.5 meters (4.9 feet) of the reactor fuel was exposed. The reactor fuel appears to have at least partially melted, and the subsequent explosion has shattered the walls and roof of the containment vessel – and likely the remaining useful parts of the control and coolant systems,” Stratfor explains [3].
“Given the large quantity of irradiated nuclear fuel in the pool, the radioactivity release could be worse than the Chernobyl nuclear reactor catastrophe of 25 years ago,” said Kevin Camps [4], a nuclear waste specialist.
Prior to the explosion of the containment structure, exposure rates outside the plant were at about 620 millirems per hour [5]. Radiation exposure for the average individual is 620 millirems per year. Virtually any increase in ambient radiation can raise long-term cancer rates, and authorities distributed iodine, which helps protect against thyroid cancer, The Oregonian [6] reports.
As the image above illustrates, the prevailing jet stream [7] moves from Japan to the United States across the Pacific Ocean. Airborne radiation would work its way into the jet stream and reach the United States in less than 36 hours. Jet streams flow from west to east in the upper portion of the troposphere.
By downplaying this serious disaster, the Japanese government is not only endangering its own people, but also millions of people in the United States and Canada.


The cover-up by the Japanese government provides more evidence that government cannot be trusted to safeguard the lives of its citizens.

TriMet needs to stop spending money on more "extravagant" things and start putting its focus back where it belongs—on services for the people. Public services need to be the top priority for the public transportation organization.

If TriMet wants to spend money on extras, then it should first be sure to reinstall lines and stops that have been cut out rather than spending extra on things that are not necessities.

JASON BARBOUR WIEGHS IN ON MAKING THE TRIMET BOARD ACCOUNTABLE


It makes absolutely NO SENSE that the people have no voice regarding a service that everyone can use everyday. Go to Portland City Hall... Randy Leonard says "it's not my jurisdiction," go to any of the counties, they won't listen either. Better yet, go to Metro (which has the authority to assume TriMet's operations), IMO they're too patsy to do it! They won't even discuss it.

I watched the video of Jon Hunt being cut off at the board meeting. IMO, that was the most totally inappropriate thing for a public official to do. I don't care that he's an unpaid gubernatorial appointee... he needs to go. TriMet wants riders to "respect the ride," but it is very clear that TriMet doesn't respect riders or the very people that are actually providing public transit revenue service.

Someone ought to start an initiative petition. Most of the rest of Oregon hates TriMet so much for taking up state money to overbuild rail in the Portland area, and if the November ballot measure was any indication there's not much support from locals, either.

Don't get me wrong... up in Spokane I get to ride brand-new, clean, comfortable buses (the oldest buses are about the same age as the TriMet 2000s and are MUCH better) that show up reliably and logically meet at the downtown transit center where riders can reasonably make connections. There are 60' buses for the crush load routes with free wifi. The operators are respected by virtually everyone and those who don't get to enjoy walking down streets that are comparable to Portland's NE/SE 82nd Ave.

I realize someone will probably try to tell me that Spokane Transit can do that because they serve as many people in a year as TriMet does in a month and has a much lower transit mode share... hogwash. TriMet SHOULD be a system we're all proud of. TriMet SHOULD have the best public transit revenue service (but they don't). TriMet SHOULD treat the general public with the same regard as other cities. TriMet management SHOULD NOT be declaring war against those who actually provide service. TriMet SHOULD have an elected board and a Citizen Advisory Committee that actually represent the people, not wealthy corporate types who want transit to suck.

Based on a recent Forbes survey, Rachel Maddow revealed that while Wisconsin Gov. Scott Walker is stripping away the financial security of workers, the Koch brothers increased their wealth by $9 billion last year. Together, Maddow notes, they would rank as the fourth-wealthiest person ($44 billion) in the world.
Meanwhile, the Koch brothers and Karl Rove, among others, are using front organizations to pit working people, who are being exploited, against unions. It's the ultimate in class warfare: make the working class fight each other over an increasingly smaller piece of the financial pie, as the super wealthy run off with the bakery.
That's why ads in Wisconsin - and stories on Fox - are trying to get Wal-Mart low-wage workers to resent that union members receive better benefits, which of course - on a logical level - reinforces to many of us exactly why unions are needed: to prevent the impoverishment of people who labor for a living.
What's not mentioned in these ads, or the right-wing media echo chamber, is why the government is subsidizing the wealthy who don't pay their fair share.
Scapegoating union members while the outlandishly rich just get richer is a gross injustice. There is a price to be paid for democracy, and the Koch brothers - and all the corporations that pay little or no taxes, as well as individuals - should ante up for what this nation has offered them.

HIGHLIGHTS FROM TRIMET EXECUTIVE BOARD OFFICERS REPORTS


1-Two Union officers have filed complaints about part timers getting work that was supposed to go to full timers. Although Jon Hunt says there is no threat to the part time 3 day program, after reading the labor press I find that hard to believe. I personally am against the “rich get richer” as public policy.

2-Lots of people getting in trouble with the Reed group and time loss issues. Trimet puts the responsibility on operators to keep track of all their vacation, sick, femla leave. Operator’s errors in this area are leading to terminations due to time loss.  I dealt with Reed Group briefly; their process is slow and cumbersome. Trimet is no help, basically useless to you. Watch your time loss and check constantly for mistakes.

3-Trimet operators are getting tickets and discipline for every single infraction on the road. WATCH YOURSELF OUT THERE! Bus operators worldwide are being attacked at every opportunity, and that includes us.

4- Trimet, the agency that is pushing safety as a ‘culture’, continues to ignore the safety issues surrounding the type 4 trains. At TRIMET everything that happens out here is the OPERATORS FAULT.
The management takes no responsibility, even when they ignore safety issues brought to their attention. David Sale, Robert Butler, and plenty others know what I am talking about.

5-TRIMET policy regarding disciplinary procedures is to settle nothing except through arbitration.
“Don’t settle anything with the union” is official policy.

6-If you file workers comp, you will be investigated. Some of the questions will have nothing to do with your injury. The investigator is basically trying to trip you up. Stick to the facts and answer in brevity.  The less information you need to give up the better. (That applies to everything actually)

            I am in receipt of some emails that have informed me of an email you sent them. It states:
Brother Day,

If the people who signed their names don’t agree with your charges against Sister Fox why did they sign their names? Did you not show them the charges? What were they signing their names for if not to express their opinion that the charges have enough validity that they should be aired in a meeting, in public?  Are you saying Sister Fox has no right to know who is accusing her? That is such a basic tenant of justice that I cannot understand your position. Nothing in the constitution says that people can be brought up on charges on the basis of secret signatures. And yes, you can’t control where that information goes once the charges are published. Neither can I. As you noted, only four other signatures besides your signature are necessary. If anyone is uncomfortable with having their name associated with these allegations then they need to remove their name. I suggest you talk to folks and reduce your list to four besides yourself. You still have time to do this. Again, let me know your decision.

            I am unclear of your intentions of sending this communication to members. Currently I perceive this as a form of intimidation to get members to withdraw their names from the filing. To assure members that they are welcome to sign or withdraw their signatures I have posted your email message on my blog site. This will allow members to free come forward to who they feel comfortable with and perform the action they feel best. I do want to assure the Chris Wubbenhorst name is withdrawn from any and all filings I have submitted.

            Learning of your actions I am checking with members that request to remain named on the filing and advising them to be prepared for more retaliation. If they do not feel comfortable with keeping their names on the filing I will request their names to be removed. I will be addressing your questions that you posed and will have some for you as well. For now I want to make it clear to you that as long as I have the allotted number of signatures for this to move forward, I want it to move forward. If there is any changes on my filing I am to be advised immediately and given the opportunity to make sure the filing stays intact.

ATU 757 Members:
I read Neil McFarlane's communication to TriMet members titled "Connecting the Dots." In his communication, McFarlane preached the ago-old party line that separate pots of money can only be used for certain things.
For example, McFarlane claims he has enough money to pay for the Portland-Milwaukee Light Rail Line, he just doesn't have enough to pay wages and benefits to operate the service, unless of course, employees are willing to take less. Beginning to sound like what's going on in Wisconsin and Ohio?
Ask yourself. If TriMet bought buses, signed a contract and then stopped paying the agreed upon terms claiming they had less money than they had budgeted for, what do you think the bus manufacturer would do? What if TriMet contracted with a company to build light rail and the contractor halted the construction claiming they bid the job too low, what do you think TriMet would do?
The contract dispute between TriMet and the Union is no different! TriMet signed a contract with its unionized employees. Contract disputes for transit workers in Oregon are covered by state law which provides a legal and mandatory process those parties to a contract are bound to comply with. TriMet refused to comply with that process, and unilaterally and unlawfully imposed changes to the party's contract. What did the Union do? It filed an unfair labor practice complaint with the Oregon Employment Relations Board.
Remember, Neil McFarlane told union officials in a face-to-face meeting that had the Union not exercised its legal right to file an unfair labor practice complaint, he (McFarlane) would not have implemented the contract change. So, instead, McFarlane violated the law and is now asking employees to accept it.
Just like TriMet and its contractors would not accept a breach of contract, neither should the employees accept a breach of their labor contract. This so-called "bridge agreement" that McFarlane wants employees to accept represents a double-edged sword. He wants employees to accept huge concessions now to obtain an agreement, and then immediately submit the contract to an arbitrator from whom they will seek more concessions. Does that seem like a good thing for the employees?
TriMet needs to rescind its unlawful implementation, and return to the bargaining table in an attempt to resolve the dispute. If an agreement can't be reached, the dispute then moves forward to arbitration as required by law. The arbitrator will then decide on the terms of a new agreement. That is what the law requires. The Union has always agreed to follow and abide by the legal process. Now, it is time for TriMet to do the same!
And for anyone who believes Neil McFarlane when he tells you that the money TriMet saves from making you pay more for health insurance and take less in wages will not help fund light rail, maybe you don't remember or weren't here in 1985 when union employees took a five percent wage rollback to pay for the Westside light rail. And by the way, when the unionized workers suffered that five percent wage rollback in 1985. management received a ten percent wage increase several months later.
