600 snakes found on bus!

Passengers on a bus in Argentina got an unwelcome surprise when police found more than 600 snakes and other reptiles packed in the luggage compartment.
Acting on a tip-off, police intercepted the bus in a northern province bound for Buenos Aires, asked to see passengers' documents, then began poking into their bags.
"A passenger came onboard with 40 snakes, plus what he had in the boxes" in the bus luggage hold, said ranger Daniel Chersich, warden of Santa Fe province.
Police "were terrified of opening the bags," Chersich, who was investigating a wildlife trafficking network and joined in the operation, told the daily Clarin.
With good reason.
The trafficker had loaded them with 444 boas, vipers and other snakes; 186 endangered tortoises; 40 lizards, and an armadillo.
The smuggler, who was arrested, boarded the bus in Santiago del Estero, where he had spent three months trapping various species in the bush with the intent of selling them, Chersich said.

Wrongful Death Claims Against Public Entities: Recoverable Damages Increased

Austin Miller was killed after being struck by a bus operated by Tri-met, a governmental agency.  Austin Miller was survived by his parents, his only statutory-beneficiaries.  A personal representative for Austin Miller’s estate (hereinafter “Plaintiff”) filed a wrongful death action against Tri-met.  The parties disagreed about whether or not Plaintiff brought two claims—one for each beneficiary—or one claim on behalf of the decedent.  The trial court determined Plaintiff brought two claims, one claim for each beneficiary and awarded $375,000, $187,500 for each beneficiary.

I am the farthest thing from a right winger, but on the issue of light rail above everything else I stand firmly behind them.

It seems that rail is being pushed almost exclusively by liberals. Ergo, it has more to do with politics than actual value-added to the community. TEMPEST IN A TRANSIT BUS-great title!

I consider myself an avid Transit user having taken the bus every day for the past three years. I always know what time the bus is supposed to come, where I'm going and where I'm supposed to get off. If I am unsure about a route, I'm comfortable and capable of asking the driver.
To say I was annoyed when Transit first introduced calling out every stop from inside the bus would have been an understatement. Obviously, this new system wasn't meant for my enjoyment but I understood why and how the new system would benefit those whom it was for.
It took a few weeks until I had myself trained to tune out the constant voice. Having an MP3 player or other means of distraction with me helped a lot during the transition. I managed to find a happy medium between an enjoyable volume of music that would drown out the constant reminder of where I was headed and would not upset my fellow passengers.

More on the T&I Stakeholders Meetings: The Advocates Edition

Larry Hanley, president of the Amalgamated Transit Union, went right after Millar but took a more combative tone. Recent transit cuts – the deepest since World War Two – are “unconscionable” and further cuts would be “a criminal act against the people of our cities,” he said, threatening people’s ability to get to work in the midst of an economic crisis. Janitors sometimes have to stay in the buildings they clean for hours after their shifts end to wait for the next bus, he said.

NO RESPONSE FROM HAYDEN BUT HERE IS THE RECCOMENDATION AND THE ACTUAL SOP

B804 Serving Bus Stops
by Admin — last modified Dec 01, 2010 01:27 PM
Revised 11-18-2010. Leaving a bus stop section changed.
1.0 Purpose:
This procedure outlines how to enter and leave bus stops and serve customers at bus stops. Additional requirements for serving customers at shared bus stops are outlined in SOP B805 Shared Bus Stop Procedure and information for operating in service lanes on the transit mall are outlined in SOP B807 Portland Mall Operating Procedures. Also see SOP B701 Serving Customers with Disabilities for information on serving disabled customers.
2.0 Procedures:
Entering a bus stop and serving customers:
1. Use right turn signal to indicate your planned move into the bus stop.
2. Keep turn signal on while pulling into the bus stop and while serving the stop.
3. If the stop has more than one bus position, pull up to the first open position. Be sure the boarding location for customers is safe and easily accessible.
4. Open doors to service the stop and make all required announcements.
5. Keep brake pedal covered with your foot or set parking brake while doors are open.
6. Board any customers. Greet or acknowledge customers as they board. Respond to any customer questions in a polite, respectful way.
7. Once all customers are aboard, close your doors, turn on your left turn signal and yield signal. Do not use the Yield signal on the Transit Mall.
8. If a customer appears at the door after the doors are closed, use your discretion in deciding whether or not to board the customer:
Will boarding the customer jeopardize the safety of the customer or the bus?
Will the customer be waiting in inclement weather?
Will the bus impede traffic movement if the customer is boarded?
Is your follower coming soon?
TriMet does not encourage customers to walk into traffic to board a bus. However, if it is safe, allow the customer to board.
Leaving a bus stop:
1. Scan the doors for clearance and then close them keeping your left hand on the door control and your head and eyes turned towards the doors until they are completely shut. Do not move the bus with the doors open.
2. Make sure the front and rear doors are cleared of customers and your mirrors are visible. Passengers may not block mirrors, stand in the stairwells, or stand ahead of the yellow line at the front of the bus.
3. Release the right turn signal and turn on the left turn and yield signals. Remember that the Yield signal may only be used to exit a service stop at a curb to reenter a travel lane. The Yield signal may not be used on the transit mall, or for turns or lane changes.
4. Turn your head left to scan the left side and mirrors.
5. Turn your head back to the right, sweeping your vision across the front of the bus and scanning for all potential hazards. Scan the right side and mirror, and remember to rock and roll (lean) in the seat to see around right side vision barriers.
6. Turn your head left for a second scan of the left side and mirror. Scan the interior center mirror as you sweep your vision back to the left to check that your customers appear ready for the bus to move. Look over your left shoulder and rock and roll (lean) in your seat as you scan left to increase what you see in the mirrors, and to see around vision barriers.
7. Enter traffic only when there is a sufficient gap. Do not assume other vehicles will yield.
8. If traffic conditions delay your movement, completely rescan left, right and left before moving.

Bill Of Rights Targets Mass Transit Headaches-Trimet should consider this

The Transit Workers Bill of Rights would give commuters the right to expect on-time, efficient service, and clear notification if service is running late, specifically before swiping their MetroCards. The bill states commuters should be notified via internet, email, or text message and through P.A. announcements in stations if a bus, subway or commuter train is more than 15 minutes late.

It was "human error" and she's "sorry" about it.
Can you sense my eyebrows being raised?
One thing I can tell you is that when "mistakes are made", the first thing that an information hoarder does is fix everything before reporting the mistake.
I think there is enough here to launch a serious investigation. Not just a recount, but a criminal investigation. The fact is many Wisconsinites will consider this fraud unless it's proven otherwise. That may not be fair, but it's a fact.
Kathy Nickolaus needs to answer a lot of questions. Her computer should have been seized and locked away as soon as the error was reported. It should be given a thorough forensic exam. When did she realize the mistake? Did she change anything in any file after she discovered her error? Who did she tell and when? Why didn't she just tell the AP right away if it was an honest mistake? Did she have access to any of the physical records like ballots and election logs? (I presume she did, being the clerk.) Where were those documents over the last two days? Did she alter them in any way?

As Schneider notes in the NRO piece, Waukesha's County Clerk Kathy Nickolaus had indeed come under scrutiny for her election procedures in the past. At a press conference moments ago, Nickolaus attributed the confusion in numbers to an error in Microsoft Access on her computer.

REQUEST MADE TO HAYDEN TALBOT FOR CLARIFICTION OF POLICY

Hello Hayden;
I would like a policy clarification please.

It had been the policy of this agency to allow movement of the bus as soon as passengers had “moved safely behind the yellow line”. (With exceptions)

I’m sure you are aware that many people take quite a long time to actually take their seats and some people choose to go way to the back of the bus in a nonchalant style that can actually take quite a long time.

Is the policy now that the bus cannot be moved until passengers “are safely seated”?

If there is a fall before a passenger is seated is that an automatic PA?

If yes to the above what about people that refuse to sit or overloaded buses?

This needs to be clearly defined to us as operators.

Thank you,

Al Margulies

Not giving up on Harry yet

In fairness to Harry Saporta, he did just get here so it's not quite fair the expect him to make any sort of changes right out of the starting gate.
However this is our opportunity as bus operators to see that some changes are made around here, we need to utilize him! I got another response from him today:

Al,
I will be meeting with Ken Zatarain to review and understand his response in detail. I will get back to you.
Harry

To which I responded:
Harry,

I genuinely think this policy needs to be changed.
Take for an example that when an operator picks up his bus at the garage, policy is that 10 minutes are allowed to get the bus going and set up before departing on a given route.

I do not feel that allowing 5 minutes to perform a road relief is something that should be trivialized.

"Making up time" somewhere else in the route is defective thinking and needs to change.

When that BDS clock starts showing minutes late, all bus drivers start speeding up, its our conditioning.
It should be obvious that "speeding up" will increase chances of accident.

I did a rant on this subject, perhaps you would be interested in hearing it.
I do have a public blog which covers various topics one of which are my experiences at Trimet, you most likely have never heard of it.

If there is anything in there that offends you I apologize in advance, I am just thinking out loud, but the topic of road reliefs is something very important to me:

WE WANT ALL THE MONEY...THE DOWNSIDE OF UNIONS

Press - April 5, 2011 7:05 AM ET
BURLINGTON, Vt. (AP) - Dozens of unionized Vermont bus drivers are unhappy with the contract their union has reached with the Chittenden County Transportation Authority.
About 35 drivers picketed on Monday to protest a provision of the contract being negotiated on their behalf that would allow part-time drivers.
Driver Nathan Bergeron says a proposed increase in part-time drivers would erode the earnings of the full timers.
CCTA officials say no full-time driver would be laid off to hire a part-time driver, but part-timers are needed to relieve pressure on the full-time drivers.
Union representative Duane Messier says the picketing was not sanctioned by the union.
Messier tells the Burlington Free Press the union's executive board approved the contract and presented it to members on March 13.
The contract has been approved by CCTA.

Man On Tricycle Wins Race Against N.Y. Bus

Manhattan's 42nd Street crosstown bus is notoriously slow, and one New Yorker has proved just how slow — by racing the bus for one mile while riding a child's tricycle. Comedian Mark Malkoff pulled alongside the bus at 10th Avenue. The bus jumped out to a lead, but Malkoff chased it down and pedaled to an easy win at Madison Avenue, beating the bus by 2 minutes and 38 seconds.

Maybe somebody should try this vs the streetcar here in Portland!

GLENN BECK GETS CANCELLED!

This message is a long time coming, and it feels good to finally tell you the news. Yesterday, Fox News announced that later this year, toxic talk show host Glenn Beck would "transition off" from his nightly hour of hate, falsehoods, extremism, and absurd conspiracy theories.
It's thanks to your support that we've been able to continually monitor and fact-check Beck and his relentless tide of smear campaigns and lies. With your help, we've been able to make the case that Beck has a dangerous impact on the national conversation -- and we've been able to ensure that Fox's promotion of Beck has had real-life consequences for the network's credibility and its advertising dollars. Beck's show has lost nearly 1 million viewers in the last year, and more than 300 advertisers since its debut.
It took two years too long for this to happen and the fight isn't over: Fox News and its allies in the right-wing media will continue to distort and undermine the political process. The right-wing noise machine still injects political attacks and falsehoods into our national debate through outlets like Fox News and talk radio.

Nobel Economist Joseph Stiglitz: Assault on Social Spending, Pro-Rich Tax Cuts Turning U.S. into Nation "Of the 1 Percent, by the 1 Percent, for the 1 Percent"

This week Republicans unveiled a budget proposal for 2012 that cuts more than $5.8 trillion in government spending over the next decade. The plan calls for sweeping changes to Medicaid and Medicare, while reducing the top corporate and individual tax rates to 25 percent. We speak to Nobel Prize-winning economist Joseph Stiglitz, who addresses the growing class divide taking place in the United States and inequality in a new Vanity Fair article titled "Of the 1, by the 1, for the 1%." Stiglitz is a professor at Columbia University and author of numerous books, most recently Freefall: America, Free Markets, and the Sinking of the World Economy. "It’s not just that the people at the top are getting richer," Stiglitz says. "Actually, they’re gaining, and everybody else is decreasing... And right now, we are worse than Old Europe."

Wall Street and War

Americans are recognizing the link between the military-industrial complex and the Wall Street oligarchs—a connection that goes back to the beginning of the modern U.S. empire. Banks have always profited from war because the debt created by banks results in ongoing war profit for big finance; and because wars have been used to open countries to U.S. corporate and banking interests. Secretary of State, William Jennings Bryan wrote: “the large banking interests were deeply interested in the world war because of the wide opportunities for large profits.”

HARRY DOING THE BUREAUCRATIC SHUFFLE!

It appears that our new safety 'director' has taken my concern for road reliefs having proper time for operators to set up the bus and sent it around to the same people that already told me to "write a yellow card".
This is my response to Harry:

The case was closed out because they didn't hear what I was saying!
Let me try again.
Neil Macfarlane has said safety is too be a "cultural" value.
That means every aspect of our operation must have safety as its #1 concern.
With that said, having a road relief with no time programmed into the relief for an operator to set up the bus FOR SAFETY before hitting the road is NOT SAFE!
The institutionalization of "putting enough time into the route" to make up for things like this is DEFECTIVE!
The thinking needs to change.
That is what Neil Macfarlane has been preaching is it not?

ATU 757 PRESIDENT JON HUNT CLEARS UP SOME MISINFORMATION ON A PAST FILING

CHRIS DAY CONCEDES BASED ON POINT OF LAW

The question is why didn't the union officials make this clear in the beginning so we could have avoided all this?
I asked that question and Yvette (treasurer) said that we don't investigate this until we are "pushed" into it.
Personally I find that a rather odd way to conduct business, but I am not in her (or others) shoes.

As you can see from the above "libel" is protected under the labor rules.
So Ellen, or anybody for that matter, is free to liable anybody else in the union.
The union cannot penalize a member for liable.
The union it appears agrees that Ellen has indeed been engaging in libelous activities, but there is not a damn thing they can do about it.
However, these cases can be settled in civil courts.
---------------------------
Chris Day comments:

Al,
You continue to use the word liable when you talk about this. I feel by just saying liable is creating the illusion that there are forms of speech that is protected. Within our Union all and any speech is protected. Unions are not permitted in any manner to discipline any member for almost any type of speech. The only type of speech that our Union can address is if the speech harms the welfare of the organization. This means if a member attempts to promote a different Union to fellow members our Union can discipline that member. Any other form of speech is protected from Union intervention.

What this means is any member including officer can say anything they want (as long as it is not trying to break the union). Our members and officers do not have to be honest with each other and can give false information as they please. Our union cannot protect us from any type of speech. Any violation of civil freedom of speech laws can only be handled by local, state and federal courts.

So say whatever you want to say about whoever you want, our Union is not able to do anything about that and it can only be handled in court.

757 WILL BE SUED?

It seems that the officers put forth the argument that 757 will be sued if it went forward with the preferring of charges because libel is protected under free speech.

Information is that the union officers did not provide any supportive evidence as to how they came to that conclusion.

This argument swayed the members to vote no on the preferring of charges.

Meetings will continue however, stay tuned!
Motion to prefer charges against Ellen Fox soudly defeated! No details at this time but my guess is Jon Hunt had lots to do with it!

KEEP THE DREAM ALIVE RALLY

Before the Monday, April 4th Charter meeting, join us at Director Park in downtown Portland for the Keep Dr. King’s Dream Alive Rally. Stand up against the Koch Brothers who helped put Wisconsin Governor Scott Walker in office and are holding up contract negotiations for our brothers and sisters in Oregon at Georgia Pacific and at the Wauna paper mill. This is your opportunity to stand strong with federal workers whose jobs are uncertain so long as anti-worker elitists in Congress refuse to pass a reasonable budget.
Join the Oregon AFL-CIO, the Northwest Oregon Labor Council, the ILWU and your fellow union members to keep Dr. Martin Luther King Jr.’s dream alive on the anniversary of his death. This rally will begin at 5:30 pm and will be moderated by Carl Wolfson, comedian and host of The KPOJ Morning Show at Director Park, at SW 9th and Yamhill. Afterwards show up for the union meeting at the Salvation Army Rose Center.

Yet America remains a nation at war, and it’s important for Americans to understand the cost of its longest war in history, in Afghanistan. PORTLAND'S "MOST LOVED" BUS DRIVER WRITES AN EDITORIAL

Hopefully this will be the first of many from Dan Christensen!
I seriously wonder if they staid up all night trying to game out all the different ways this very small area at the end of the train can be used. did they have some sort of Arthurian round table of high paid managers working late into the night, sleeves rolled up working on a list of who could use the bike area, or.. and I think this is more likely, just before someone went home on friday they suddenly realized that they had a policy changed and no excuse other then “Hey lets stick it too em”
This has all the hallmark of someone looking up from their computer seeing they had only two minutes to go until the end of friday and shouting. “Hey someone give me a couple of other uses for the bike area?
“Strollers” shouts one employee grabbing up their car keys.

Balancing the budget on the backs of the weak and needy: Is this not a form of class warfare?
Put another way: people who can afford to never take the bus, like city councillors and $200K public "servants," taking it out on people who are stuck on OC So-So. Asking the elderly, in particular, to bear the burden of a cooked-up budget crisis is pathetic.

HARRY SAPORTA ACTUALLY GIVES ME A DECENT ANSWER ABOUT MY SAFETY ISSUE

MAYBE THIS GUYS WILL ACTUALLY BE GOOD!

Al,
Thank you for bringing this issue to my attention.  I will look into the time allocation for relief operators.  I will also be placing this issue in the Request for Safety Assessment (RSA) system.  I will be sure to get back to you next week with an update.

Subject: Safety concern
I am aware that you have now started in your position as the safety director.
I want you to know that road reliefs that have no time built into the relief so a bus operator can properly set up a bus (adjust seat, mirror, etc)are a definite safety hazard. Operators that are forced to leave the relief late will feel pressure from schedule and operators that do not take the time to do the proper adjustments risk increased chance of accident.
Maybe you can do something about this.

REMEMBER JOSE MEJA POOT?

I sure do, like it was yesterday. This whole tragedy started over a fare on one of our buses, if i remember correctly, was 25 cents short.
It turned into a police call, they hauled him off to jail, then to the mental hospital, where he was killed by the police which then closed down the hospital.
I was very embarrassed that one of our bus drivers created this mess over chump change.

Dispelling the Myths of light rail

Light rail transit (LRT) has become a fad among urban planners in mid-sized North American cities. They argue that LRT is a happy medium between buses and subways. In reality, LRT combines the disadvantages of both. LRT is slow, inflexible and expensive. Moreover, the CTrain has exacerbated the very problem it is meant to fix: rampant urban sprawl.

http://www.fcpp.org/publication.php/3704

The high cost of Calgary’s low-cost transit

The episode, aside from the awfulness of the accident, highlighted one of the costs of a city grown dependent on commuter rail. When serious disruptions occur, the repercussions can be enormous: tens of thousands of people can be made late for work or appointments when a train crashes into an automobile, as happens occasionally, or when a pedestrian is seriously injured or killed on the track, which, sadly, seems to happen nearly as often. It makes it all the more urgent to consider a report put out this week by the Frontier Centre for Public Policy providing a critical analysis of the costs of Calgary’s widely celebrated C-Train system and recommending that its expansion be halted in favour of more flexible, responsive and affordable alternatives. It’s something other cities, most of which these days seem to be fixated on LRT build-outs, should seriously consider, too.

Another cost-effective Streetcar stop

Who says streetcars are great in traffic?

Yes, that's a streetcar...way, way back there. And there's still another dozen or so cars lined up for a traffic light behind me.

Cost-Effective Streetcar

This is a Streetcar stop (also referred to as light rail) in Toronto. Notice some of the cost-savings measures:

1. Bus shelter is IDENTICAL to that of a TriMet bus shelter.

2. No schedule information or even much signage - just that little cylinder item.

3. No art.

4. No crosswalk/pedestrian safety improvements.

5. The "platform" is extremely minimal - just enough space as is needed for people to stand.

What's not pictured is that they also used rebuilt 1940s/1950s era PCC cars, not new-build cars. And that concept works - San Francisco has an entire streetcar line that runs nothing but "heritage streetcars" and is among their most popular routes; they can even get away by charging a surcharge to ride it!
