BART CONTROVERSY RAGES ON AND ON

BART officials keep highlighting that their job is to provide safe passage for its passengers. That's true. But they are also part of a government agency with a police force. That power comes with the duty to use law enforcement authority responsibly, and with restraint.
Unfortunately, BART doesn't seem to recognize that. Police have fatally shot two men on station platforms in the past 2 ½ years.

L.A. transit activists rally for a federal probe

(This sounds very familiar!)
The union and several other activist groups at what was billed as a "transit justice town hall," accused the county transportation agency of hurting poor riders by aggressively pursuing new rail projects while slashing bus service. The groups say the cuts unfairly hurt low-income, nonwhite residents and insist that bus service needs to be expanded.
Redman described a recent experience, waiting for a transfer bus on a sun-baked curb for 45 minutes. She was dressed in a black business suit, Redman said, and she spent the time feeling miserable and praying for her bus to arrive and shuttle her toward Santa Monica.
"I wanted to cry. I was hot and sweaty," Redman said. "I was late for the interview."

CURIOUS ISN'T IT?

A handful of people listen to the dispatch calls, I'm one of them obviously.
What I find curious is that with all the overheated broken down buses that occur when it gets about 85, why are the bus on time statistics NOT horrible, I mean dastardly?

Trimet statistics present bus service as being on time 80% of the time?

I can't possibly believe it, there are far too many missed and late trips to make that figure even remotely believable.

WHAT TO DO IF YOUR JOB AT TRIMET STARTS KILLING YOU

Extreme heat introduction

This summer has brought a heat wave with unusually high temperatures that have lasted for weeks. High temperatures can be potentially dangerous to one's health.
People suffer heat-related illness when the body's temperature control system is overloaded. The body normally cools itself by sweating. Under some conditions, sweating is not enough to cool down the body. In such cases, a person's body temperature rises rapidly. Very high body temperatures may damage the brain or other vital organs.

WHAT CAN HAPPEN TO TRIMET BUS DRIVERS DRIVING DINOSAURS?

A healthy body temperature is maintained by the nervous system camera. As the body temperature increases, the body tries to maintain its normal temperature by transferring heat. Sweating and blood flow to the skin camera (thermoregulation) help us keep our bodies cool. A heat-related illness occurs when our bodies can no longer transfer enough heat to keep us cool.

No safety at TRIMET, at least not for drivers

This has been a pretty good summer, all things considered. But yesterday was 93 in Portland and hotter in other places.

My safety request for driver fans in the old buses was tabled, "for further review", translation, don't call us we will call you, aka: forget it!

In the year 2011, when we are witnessing this agency spend money on all sort of frills, when the leader of this agency preaches safety everywhere he goes, we now see  the truth of where we work.

This company, and its leaders think so little of us, they cant afford a A $12 DOLLAR FAN to enhance our safety as drivers.

It's pathetic how little regard the management has for us.

Our 1st 90 degree day this summer!

Thankfully, both my buses were low floors with air conditioning yesterday.
Pity the drivers and passengers in Washington County that had to travel in the "Easy
Bake Oven" dinosaurs.

After Cellphone Action, BART Faces Escalating Protests

Early last month, a BART police officer shot and killed a knife-wielding homeless man at the San Francisco Civic Center station. The incident provoked a series of small protests that drew little attention until Aug. 11, when the transit agency took the unusual step of shutting down cellphone service for several hours as activists prepared for another rally.
With that flip of a switch, BART has come under siege — in cyberspace and underground.

According to officials, BART’s technology personnel have been working round the clock to fend off a disparate group of hackers who penetrated the agency’s Web sites last week and released sensitive information, in retaliation for the shutdown of the cellphone and wireless services.

Stop Clinging to False Hope and Face Reality

Everyone is complicit to some degree, but perhaps it is the people themselves, those being ruled, who are most to blame for the circumstances in which we all now find ourselves to varying degrees. Surely the American majority's willingness to shun the US Constitution and the Bill of Rights has enabled the "power seekers" to regulate and dominate virtually every aspect of an individual's life. For without the consent of the larger body, the rulers would have no power with which to abuse.
But as it is today, the greater mass of voters is still busy watching "Dancing with the Stars" and "American Idol." The vast majority of youth care not of real issues; rather they are focused on increasing the number of new "friends" who sign on to their Facebook accounts, or are busy discussing what Lady Gaga ate for dinner or some similar nonsense. It is a shame that people have fallen out of touch with the act of thinking and being responsible for their own lives.

VIDEO LOG-AUGUST 19(part 2)

How many presidential buses does it take to equal the cost of one light rail car?

President Obama traveled the Midwest on a new bus purchased by the Secret Service.
The vehicle is painted all-black with tinted windows and appears to be the size of a standard Greyhound bus. Inside, we can assume that it's tricked out with the latest in high-tech security gear and telecommunications and designed with a kitchen, shower, bedroom and lounge area.
Given its purpose, the price tag must be enormous.
Actually, it's not. It was purchased for $1.1 million. A typical light rail car in Portland costs $4 million.
Regular transit riders might want to ponder that. A light rail car has hard seats, no headrests, minimal legroom and no on-board internet access.
The Presidential bus can go on any road in America, while light rail is limited to just a small part of the Portland region.
The proposed Milwaukie light rail project will cost $1.5 billion. If we cancelled the project, we could buy an entire fleet of presidential buses and run them to Milwaukie, with free coffee and donuts for everyone, and we still couldn't spend as much as TriMet plans to spend on one mile of light rail.

BART’s cellular shutdown: Safety or suppression?

Michael Risher, a staff attorney with the ACLU of Northern California, said he’s never heard of a government agency taking such an action. “Not in this country,” Risher said. “This is the kind of thing we hear about happening in oppressive regimes.”
Fairow called such comparisons “unfortunate,” but agreed that he’d never heard of another agency shutting down signals.
Risher also pointed out that “jamming” cell phones, which is technologically different than shutting down a signal, was recently dismissed by the Federal Communications Commission as a law enforcement tool. Prisons and jails have sought permission of the FCC to jam the signal around lockups to prevent inmates from communicating via smuggled cell phones. One of the reasons for the FCC’s continued opposition to jamming, Risher says, is that shutting down cell signals can interfere with safety.

Uneasy riders: Mass transit systems caught short

Many U.S. public transportation systems are struggling to cover costs, with more than a third projecting shortfalls for their upcoming budget years, the American Public Transit Association said on Wednesday.
With states, cities and counties struggling to recover from the 2007-09 economic recession that devastated their revenues, they have slashed aid for local bus and rail systems. The group found that a third of public transit agencies received less funding from their local governments this year and 40 percent had fewer dollars come in from the states.
Revenues from fares have increased for nearly half the U.S. public transportation systems, the survey found, and since January 2010, 34 percent of the transit agencies have hiked the amount they charge riders and 32 percent may soon raise fares.
At the same time, since January 2010, 47 percent of systems have cut services, including reducing rush hour services and limiting locations they serve.
"Many agencies have also had to defer or delay planned capital projects, including returning existing facilities to a state of good repair or replacing aging vehicles and facilities," according to the survey, which noted that rising gasoline prices could push more riders into the system.(Trimet doing the opposite)

Milwaukie light rail commitment based on ‘quicksand of lies’

Anyone worried about the county's reputation if they "defaulted" has only to look at TriMet's believability factor regarding federal money for the Milwaukie light rail project. They knew in October of 2008 they were only getting 50 percent of the project in federal money, not the 60 percent they were telling the entire region. They waited until July of 2010 to let us in on that dirty little secret, all the time dealing with Clackamas County for $25 million and Milwaukie for $5 million. It only took them 21 months to spit out the truth, and then only because they had to. Tri-Met General Manager Neil McFarlane's comment to the Milwaukie City Council on this matter was, " We just had a little hiccup in our financing." Well, golly, Neil. Is their stance even legal, much less ethical, when their request is based on such a quicksand of lies? Why is it that everyone is held accountable except TriMet and Metro?

    REVENGE AGAINST BART CONTINUES

SAN FRANCISCO—Hackers again targeted a California transit agency that came under fire last week for turning off cellphone service in its stations to thwart a potential protest.
This time, the hackers gained access to a Bay Area Rapid Transit police union website and posted personal information on more than 100 officers.
BART Police Deputy Chief Daniel Hartwig said his office "has been made aware of the breach" on Wednesday and referred inquiries to the BART Police Officers Association. Union president Jesse Sekhon didn't immediately return a phone call.
The union's website was disabled later Wednesday.
Last week, hackers broke into BART's marketing website and released personal information on more than 2,000 customers.

Costly Rail Project Boondoggles Still Fascinate Politicians

It is this cavalier attitude toward spending American taxpayers’ money that has caused our nation – and states like California – to rack up trillions of dollars in debt with no end in sight. Clearly, this rail line has become a taxpayer-funded boondoggle, despite what its apologists say.

    ISSUES SURROUNDING THE ATU CONSTITUTION

I don't bother with Ellen's blog because its nothing more than a place for her to attack people, mainly me of course. But it was just brought to my attention via Ellen Fox Watch Blog that she is now accusing me of violating the same section of the ATU contract that she was accused of violating.

It's freaking hilarious! It's ok for her to disclose private union business (signatories of a preferring of charges) but its not OK for me to disclose private union business (ATU reports to all members).

I disclose the reports because there are 1000+ union members who NEVER go to the meetings, they deserve to know what is going on at the organization that they are paying their hard earned money into.

And because the money we pay to the union is actually the TAX PAYERS MONEY, the public has a right to know what's going on also.

I think our union should be held to the exact same standards that we hold TRIMET.

Now that Ellen found out she was protected after disclosing union business, I expect the exact same treatment from our union officers.

BART GETS WORLDWIDE ATTENTION AFTER SQUASHING FREE SPEECH

BART's action last Thursday - which ignited an international debate about technology, free speech and public safety - was an effort to diffuse an antipolice demonstration. But it spurred an even larger protest Monday that was organized online by a loose-knit band of computer hackers known as Anonymous.

"It may be BART's equipment, but that doesn't mean that they have the freedom to do whatever they want to with it," said Michael Risher, a staff attorney with the American Civil Liberties Union of Northern California.
Some civil-liberties groups said BART overstepped the First Amendment because it imposed restrictions on the speech of everyone in the area as punishment for speech and behavior that it only speculated would happen.

'BLOW UP' AT BARBUR TRANSIT CENTER?

    From Erik:

I wonder what they'll say about the little "blow up" that occurred at Barbur TC this afternoon about 5:10 PM or so. Karen commuted on TriMet for the first time ever starting a new job and as we left the Barbur TC there was a HUGE explosion from the bus area (with smoke shooting up).

When we drove around on Barbur, all we could see was one abandoned vehicle 1430 with a bunch of people standing around it. Vehicle 1430, if you may recall, is the one that left me stranded in the center of Barbur Boulevard while a TriMet Supervisor stood outside smoking a cigarette (at least he was wearing his safety vest) and left the Operator to say "Well, I can't keep you on the bus, but if you left you're on your own." Never mind the Ford F-150 truck that the Supervisor showed up in had big orange flashing lights that could have been used to SAFELY evacuate the bus...

Had the bus blown up in NYC, there'd be heads rolling...but in Portland I guess scaring the crap out of transit users in the parking lot is OK (at least one woman was running in horror).

BART has opened a real can of worms trampling on freedoms

For apparently the first time in the United States, a government agency shuttered mobile-internet and phone service in a bid to quash a demonstration — the same type of speech suppression exercised by Middle Eastern tyrannies to quell dissent.
Thursday’s move by Bay Area Rapid Transit authorities was greeted by an uproar of comparisons to Egypt and Libya. The hacking collective Anonymous responded in typical form over the weekend by defacing the agency’s website, and stealing and releasing the private account information of some 2,000 San Francisco–area transit riders.

    Jack Bogdanski editorials and exposé

Go by streetcar, lose your pension

Why Portland City Hall employees' unions continue to support politicians who will spend money on tomfoolery like the Mystery Train to Milwaukie (population 20,291) is beyond us. When those electeds overspend on their pet projects, the unions may find themselves losing their precious retirement checks:
Cities and local governments make lots of promises: to their citizens, workers, vendors and investors. But when the money starts to run out, as it has in Central Falls, some promises prove more binding than others. Bond lawyers have known for decades that it is possible, at least in theory, to put bondholders ahead of pensioners, but no one wanted to try it and risk a backlash on Election Day. Now the poor, taxed-out city of Central Falls is mounting a test case, which other struggling governments may follow if it succeeds.
    The whole thing is here.

The treasury department has issued a new dollar bill to reflect the state of the economy.

A Growing Gloom for States and Cities

States and cities had already endured a harrowing three-year financial slide when the debt-ceiling crisis darkened their outlooks even further. In the space of just a few weeks, the Republican-led standoff on spending and taxes brought them a triple dose of bad news: a budget deal that will probably lead to a significant reduction in federal aid; a bond downgrade that could eventually trickle down to the local and state level, making borrowing more expensive; and a stock market plunge that is bleeding state employee pension funds.
Washington should have been trying to find a way to help states avoid the layoffs and cutbacks that have contributed heavily to the high unemployment rate. Instead, it seems to be doing everything possible to make the situation worse in state capitals around the country.

SF transit agency’s cell phone shutdown: Shielding commuters or hints of Orwell?

(Robin Weiner, File/Associated Press) - FILE - Commuters enter and exit a Bay Area Rapid Transit station in San Francisco’s financial district in this Sept. 15, 1997 file photo. Officials with the Bay Area Rapid Transit system, better known as BART, said Friday Aug. 12, 2011 that they blocked cellphone reception in San Francisco train stations for three hours to disrupt planned demonstrations over a police shooting.
SAN FRANCISCO — An illegal, Orwellian violation of free-speech rights? Or just a smart tactic to protect train passengers from rowdy would-be demonstrators during a busy evening commute?
The question resonated Saturday in San Francisco and beyond as details emerged of Bay Area Rapid Transit officials’ decision to cut off underground cellphone service for a few hours at several stations Thursday. Commuters at stations from downtown to near the city’s main airport were affected as BART officials sought to tactically thwart a planned protest over the recent fatal shooting of a 45-year-old man by transit police.
Two days later, the move had civil rights and legal experts questioning the agency’s move, and drew backlash from one transit board member who was taken aback by the decision.
“I’m just shocked that they didn’t think about the implications of this. We really don’t have the right to be this type of censor,” said Lynette Sweet, who serves on BART’s board of directors. “In my opinion, we’ve let the actions of a few people affect everybody. And that’s not fair.”

How about this deal, they ask: build the bridge, but just connect the Portland streetcar loop to it? Forget the crazy MAX train to Milwaukie -- run more express buses down there instead. Interesting idea. Probably makes too much sense for Portlandia.

So, Metro service is spared from deep cuts, and pay as you leave is going away. There are some other parts to the deal, but these are the ones that matter most to me.

There was a dead line of July 30th, 2011 for the documents to be delivered to the member. It is not clear that this dead line had been met, yet it appears that the member has received the documents and the proceeding is moving forward.
Because the proceedings are moving forward and the member has the required documents as stated in our communications I find the intention of “Preferring Charges” towards President Jonathan Hunt Null Void and is not warranted.
