Past rulings- Trimet vs ATU 757

Based on the findings of this study, a discernible pattern was observed that shows that there is a correlation between preventable collisions and the length of transit operator driving hours.

According to this study TRIMET is hardly a safe environment for people to operate buses. There are very few 8 hour shifts here, most employees are forced into working long hours. SAFETY IS NOT FIRST IN THIS ORGANIZATION ACCORDING TO THE STUDY!

following distances). But crashes and observations of driving performance show that 97 compensatory strategies are not sufficient to remove all excess risk (8). 98
The most general factors that cause fatigue are lack of sleep, bad quality sleep and sleep 100 demands induced by the internal body clock. Besides these general factors, prolonged driving 101 (time-on-task) can increase driver fatigue, especially when drivers do not take sufficient breaks.

DOT ORDERS-TriMet Language Implementation Plan

TriMet Language Implementation Plan

As part of its application for a cooperative agreement under the FTA’s Transportation Equity Research Program (TERP), the Tri-County Metropolitan Transit District of Oregon (TriMet) developed the attached plan in 2006. The plan’s contents are consistent with the guidance on an effective language implementation plan expressed in Section VII of the the U.S. Department of Transportation’s Policy Guidance Concerning Recipients' Responsibilities to Limited English Proficient (LEP) Persons [Federal Register: December 14, 2005 (Volume 70, Number 239)]. The attached plan directs a cross-section of departments within the transit agency to undertake language assistance activities including the following activities that are recommended in the DOT LEP Guidance on an implementation plan:

Seattle Metro

Bus drivers accounted for just 30 of Metro's $100,000 employees last year; and just 1 percent of all bus drivers made $100,000. Supervisors, managers, engineers and planners accounted for most of the transportation department's six-figure workers.

The Tea Party and American Exceptionalism

If I were to speechify to a conclave of Tea Partyers, “America is the free-est...the most democratic...the best educated and most dynamic country the world has ever known, an example to all mankind,” the assembled would hoot and hooroar and applaud in dizzy exaltation. Here is the soul of the American approach to existence, bottomless self-admiration devoid of knowledge or curiosity, wrapped like a psychic burrito in the patriotism of overwrought middle-schoolers. And there are many, many of them.

…where was any media coverage of Joel preventing a fatality? Don’t get me wrong, I’m thrilled that this is at least getting internal recognition at TriMet. Donna said it, I’ve said it (more than once), and now Joel, and who knows how many other operators that I just don’t have links for – TriMet bus and rail operators really are saving lives every. single. day by compensating for the poor attention of / decisions made by the public around the buses and trains. This is not news to any operator, but it’s nice that this was distributed to other TriMet employees who don’t see it the same way since they’re not out in the field.
But Joel is right – if an operator does something stupid, there’s no end to the media coverage of it, and no official support from TriMet in the media for the rest of the operators who do their jobs, and do them well. The fact that operators prevent hundreds of horrific accidents every day, well, I guess that doesn’t sell as many newspapers as “look at the dumb thing this bus driver did!” TriMet bus ridership averages around 61 million boarding rides per year, the overwhelming majority of which DON’T make the news. Then one woman in August and another in September had negative interactions with bus operators when their small children were being fussy, and now somehow it’s fair that the public is viewing all bus drivers as baby-haters?

I seem to be on the wrong side of public opinon, again

We count as our treasures what we have been socialized to count as treasures, though they defile our lives and make robots of us all: the automobile, the TV, the encapsulated suburban existence, the gleaming high buildings, the ever-rising GNP, 'fast' food. Fall Attendance Campaign
Our summer attendance campaign was a great success. We saw improved attendance in Operations this summer. Thank you for supporting our customers and each other!
We’re on the right track, now let’s keep moving. We launched a fall attendance campaign on September 1. Like the summer campaign, during the months of September, October and November, we will have prize drawings for $100 or $25 gift cards; all operators, supervisors, and maintenance employees who have perfect attendance during each month will be entered into the prize drawing.
What about employees who make it through all three fall months with zero chargeable time loss? Those folks will have a chance to win paid time off!

Shelly Lomax says

At a recent TriMet board meeting a customer came forward with her laptop and played a snippet of video and audio from a bus ride. The audio and video were played without context, but as you may imagine, it was intended to cause raised eyebrows about an interaction on a bus. This sharing of video was on the heels of a photo sent by a customer to the local media making news.
Both of these incidents serve as a stark reminder that with pocket video cameras, smart phones and the like, every interaction has the opportunity to become a "YouTube" moment.
Please continue to use good judgment out there, stay off your cell phones when driving and stay calm when dealing with difficult people (contact Dispatch for help when you need it). Let the only thing they "catch you" at is doing a great job.

Gresham Transit Center changes explained

Attention operators of lines 4, 9, 12, 20, 80, 81, 82, & 84: Bay assignments at Gresham TC have changed
The bay assignments at Gresham Transit Center changed on October 2. Previously, some buses were turning south onto Kelly from 10th Avenue (or Gresham Terrace Rd). The timing of this maneuver over the MAX tracks resulted in occasional contact between TriMet buses and the crossing gate arm.
To remedy this safety issue, the Transit Change Review Committee approved changes to the bay assignments at Gresham Transit Center. These changes improve the timing of bus movements across the tracks and minimize the potential for contact with the crossing gate:
• Line 9 arrival bay is now located on 8th Avenue.
• Line 20 arrival bay has moved to the Transit Center driveway.
• All lines that are deadheading from GTC or returning to the garage now serve the “Arrivals Only” bay located on 8th Avenue.
• Do not layover at the “Arrivals Only” bay. This bay is only for passenger drop-off prior to deadheading or returning to the garage.
Your paddle outlines these changes. A map of the new bay assignments has also been posted at the garages and is being displayed on the flatscreens.
If you have any questions about the new GTC bay assignments, please contact your manager or Dispatch.

Tyranny at Trimet-my fight for civil rights as a Trimet employee

Those that have been following this blog over the years know that I have been in a fight with Trimet management for my rights as a citizen of Oregon and the United States of America.

They contend that I violate their internal rules which require me to seek 'permission' to record any employees voice or picture, on or off duty, over the public airwaves or at any public meeting.

'Occupy Wall Street' plans Portland rally without permit

Occupy Wall Street demonstrations that began in New York two weeks ago are spreading to Oregon, with disruptions likely in downtown Portland on Thursday.
Occupy Portland plans a protest Thursday at Waterfront Park that will then march along a route not yet disclosed to downtown Portland. The Portland Police Bureau announced Wednesday morning that the group declined to obtain a permit for a march.
Occupy Portland faxed police, stating: "For best impact, we will march in the streets and disrupt the city," according to the Portland Police Bureau.
The group will meet at Waterfront Park near the Burnside Bridge at noon on Thursday, and then march to undisclosed locations in the city.
Bureau spokesman Sgt. Pete Simpson cautioned downtown businesses to be aware of protesters, and that the event will disrupt mass transit and slow down both vehicle and foot traffic.
"The Portland Police Bureau is committed to vigorously pursuing the goal of allowing participants to express their view which is there free speech right," he said, "Our overall objective is to take all appropriate action to help make this event happen in a way that is safe for participants and the general public alike." More: Read PPB release
The occupation protest is based on the Occupy Wall Street demonstrations, now in their third week, which have spurred other similar demonstrations in major cities like Boston and Los Angeles, all to protest corporate greed.

International President Larry Hanley will appear on the ‘Ed Show,’ at 10:20 PM EDT, tonight on the cable news channel, MSNBC.
Hanley will be discussing the ATU’s support for the “Occupy Wall Street” demonstrations in New York and all around the country.
ATU members participated in the Occupy Wall Street March today in New York City.  Hanley pledged ATU’s support for the movement saying, “The ATU applauds the Occupy Wall Street activists for their courage and strength to expose the greed and corruption on Wall Street as the rest of America struggles to survive. These young people are speaking for the vast majority of Americans who are frustrated by the bankers and brokers who have profited on the backs of hard working people.”
““While we battle it out day after day, month after month, the millionaires and billionaires on Wall Street sit idly by – untouched – and lecture us on the level of our sacrifice.” he continued.  "Working Americans have sacrificed too much already. Transit riders have paid with record fare increases and service cuts.  How dare they demand that we coddle the rich while poor people are losing their benefits and millions are becoming poor?”
Hanley urges all members to participate in “Occupy” demonstrations taking place in their area.

1. It is not abuse of anyone if they get off the bus. Unless it puts them in danger, bad weather, or the last bus and you strand them. Waiting for the next bus is not... NOT abuse. those who think so have to do a priority check.
2. If the child is distracting the driver with crying.. then the child is distracting the driver.. just like a cell phone or a kindle. Distraction is distraction. A bus has to roll safe.

Portland motel room burglary led to car left on tracks, smacked by light rail train

PORTLAND, Ore. — Portland police say a 1999 Subaru Legacy ended up abandoned on light rail tracks where it was hit by a MAX train after a motel room burglary in which the vehicle's owners lost their car keys as well as other items.
No one was in the car when it was hit early Tuesday. TriMet spokeswoman Bekki Witt tells The Oregonian that the operator and four students using the eastbound train for training were unhurt.
Lt. Robert King says the victims woke up at a Travelodge to find several items missing from their room and called police Tuesday morning to report the burglary. Detectives recovered video surveillance from the burglary and were able to identify the suspects coming from and going to a different room at the motel. Police made three arrests Tuesday evening.

The Joke's On Us

The whole baby incident is a symptom of a larger Trimet structural problem

ATU 757 President Jon Hunt stands behind the driver in the baby case

Strange twist in the driver vs baby case

It turns out that TRIMET management has been aware of this operators difficulties in dealing with passengers for some time now and had agreed that when she ran into problems they would immediately come to her assistance.

Apparently that assistance was not around when needed the most . There is much more to this story than what is currently available .

Management had been working with her in dealing with the difficult people and situations that occur during our workday.

This comes from Jeff Ackerson, Merlo union representative, who is currently on vacation.

It also needs to be said that this operator has an excellent record of safe operation of the bus.

A bus operator has to have a variety of qualities, but if you want to rank in them in terms of importance, being able to handle the vehicle safely is the most important.

While this whole event has been sensationalized beyond it's actual importance and damage done, once the hysteria clears, people might be able to realize that this entire event was indeed the product of an overworked and over stressed operator, a screaming child and a mob of angry passengers, which all together created a sensational media event, but in reality it was a non event.

Nobody got hurt, the woman got home, apparently picked up by her husband and the irate passengers all boarded the next bus.

Remember Marshall McLuhan,THE MEDIA IS THE MESSAGE, and that has been made completely clear in this case.

Interesting isn't it?

That the 'victim' in this non-event has not bothered to call Trimet with any sort of complaint.
Obviously she must have seen it on one of the news channels or in the paper.
So why isn't she complaining about this "horrible" driver?
My thought, because maybe she realizes that this was a bad situation and not 100% the drivers fault?

And here is one voice of reason amongst the crowd of hysterics, this is posted by one of the riders on that bus to the KATU website:

It has been brought to my attention that a student in one of these 're-certification' classes has taken offense to being presented with a retirement form as an option to doing what was being taught in that class.

Apparently the instructor created "a hostile and abusive" workplace by threatening peoples employment if they did not do what they were told.

I've heard about this tactic,  although I did not experience this during my training class however.

I thought my instructors were very professional and very informative.

Jenny Hansson from KOIN writes:

Thanks for your response, Al. Although, the passenger we spoke with said the woman was told to get off… not that she left on her own free will.

Your blog is entertaining. Just so you know, we did not board any buses or attempt to talk with any drivers. Not sure who did that---but wasn’t KOIN.

This was my response to her inquiry:
I left you a voice message, I have nothing to really say about this other than the operator screwed up, obviously under intense pressure.

I don't understand why this is news? Nobody got hurt, and the transcript shows the woman with the baby left the bus on her own free will, she was not kicked off.

You can read my comments on my blog regarding this, I have several posts regarding the situation, I DO NOT SPEAK AS A TRIMET BUS DRIVER but as a blogger who happens to be a transit bus driver.

Good Transit Is Ugly Transit

Spending a lot of money on flashy stations is also not something that Spain, the world leader in cheap and efficient tunneling projects, recommends. In a report on railway expansion in Madrid, tunneling expert Manuel Melis Maynar writes: “Design should be focused on the needs of the users, rather than on architectural beauty or exotic materials, and never on the name of the architect.” And it makes sense – the point of transit is to transport. Money buys movement, and funds are finite. When a system is running well, people aren’t sticking around to stare at the ceiling, anyway.

TriMet bus driver kicks mother, crying baby off bus in Hillsboro, 'Can't drive with noise' | The Republic

It appears that there are media outlets are out in the field trying to board buses and talk to operators!

The following is a pictorial representation of our beloved media:

What a difference a few weeks makes

It also appears from the transcript that the driver DID NOT actually kick that mother off the bus, she left on her own accord.
As usual the media seems to be ignoring the reality of the situation.

Furthermore, I would not recommend reading the comments on the various sites covering these stories. A real testimony to the complete and utter stupidity of the general population.

It appears that we are in the midst of another media feeding frenzy.

The dispatcher informed the driver of the 'baby bus' that "she had to continue driving the bus" and there "was nothing we can do about it".

Obviously we do not have to do anything. Remember, safety is a value at TRIMET, and if the driver felt that continuing in route would jeopardize safety, then they should not continue to operate the bus.

The correct response from dispatch would have been, "if you feel unsafe driving the bus please park the bus until a supervisor gets there."

This dispatcher is not one of my favorites BTW.

What really happened with the baby incident

I reviewed the dispatch call on this incident.
It appears to me that this driver just had reached her limit and "broke" which is something that happens periodically around here. This is a very hard job and the public has no sympathy at all for what we really have to put up with.
The driver did wrong in the incident, she should have never removed the mother and baby from the bus but when you "break" well, bus drivers are people too.
The following is the transcription of the call between the bus driver and dispatcher. The actual recording will not be released by me or anybody that I know at this time:

Woman alleges driver kicked mother, baby off TriMet bus -

It should be noted that this driver was extremely distracted and probably was unable to operate the bus safely. Unfortunately, the proper thing would have been to call for a supervisor, not just kick the woman and baby off.

Torturing bus drivers and riders for no particular reason

We are all aware that Trimet runs limited bus service on Sunday, which means of course they have plenty of low floor buses not in use.
Why in the world do they insist on assigning high floor buses to busy routes such as the 57 when that complicates life for drivers and passengers who have problems getting up the stairs?
Is it indifference or stupidity of not knowing what's going on out here?
No matter what the reason, it illustrates the gross incompetence of Trimet management.

Are we on the cusp of major change?

Choose. But choose fast. The state and corporate forces are determined to crush this. They are not going to wait for you. They are terrified this will spread. They have their long phalanxes of police on motorcycles, their rows of white paddy wagons, their foot soldiers hunting for you on the streets with pepper spray and orange plastic nets. They have their metal barricades set up on every single street leading into the New York financial district, where the mandarins in Brooks Brothers suits use your money, money they stole from you, to gamble and speculate and gorge themselves while one in four children outside those barricades depend on food stamps to eat. Speculation in the 17th century was a crime. Speculators were hanged. Today they run the state and the financial markets.
The only word these corporations know is more. They are disemboweling every last social service program funded by the taxpayers, from education to Social Security, because they want that money themselves. Let the sick die. Let the poor go hungry. Let families be tossed in the street. Let the unemployed rot. Let children in the inner city or rural wastelands learn nothing and live in misery and fear. Let the students finish school with no jobs and no prospects of jobs. Let the prison system, the largest in the industrial world, expand to swallow up all potential dissenters. Let torture continue.

Semper Fi: Marines Coming To Protect Protesters On Wall Street

The thousands of indefatigable protestors, who have been risking their eyes and recording equipment against Wall Street’s personal jack-booted thugs in the NYPD at the Occupation of Wall Street, recently garnered even more support– the US Marines. That’s the type of support that might make an NYPD cop think twice before he decides to go all Tiananmen Square on a group of teenage girls armed with chalk and cardboard signs.

Kaiser endorses longer TriMet transfers; AORTA says TriMet would come out ahead

And Howell made his group’s first public endorsement of OPAL‘s proposal, coolly brushing off TriMet’s careful projections that longer transfers would cost the agency upwards of $2 million annually.
The amount of money involved is just too small to predict precisely, Howell said after the meeting.
"They make it sound like a big deal," Howell said. "It isn’t. It’s pocket change in a billion-dollar operation."

Trial Attorney comments on Trimet

We’re #1 … not

September 23rd, 2011
This is kind of a funny story. We often find fault with TriMet, our local transit authority, but apparently TriMet thinks very highly of itself. When a U.S. News & World Report article rated Portland as “the nation’s best city for public transportation,” TriMet interpreted that to mean the agency was the nation’s top transit agency and took the ball running. TriMet spent some $8,000 on signs for its buses and trains that proclaimed “#1 Transit.”
Unfortunately for TriMet, U.S. News & World Report changed its mind, or rather, a correction noted that the original article had been incorrect, and just like that Portland dropped from #1 for public transportation to #5.TriMet plans to take down all 168 signs.

The Good, the Bad, and First Student

First Student, Inc, announced the unilateral change that effective September 30, 2011, it was cancelling the current health plan, Health Net of Oregon and replacing it with coverage provided by Kaiser Permanente in Salem, Oregon effective October 1, 2011. The impact of this unlawful change is devastating to city transit workers. These workers, who are currently receiving services from Corvallis area physicians participating in the Health Net of Oregon plan, will lose their physicians and be forced to travel an hour one-way to Salem, Oregon to receive all services provided by Kaiser Permanente. Some of these workers and family members are currently receiving medical care for and are recovering from various forms of cancer and other major medical conditions.
