How many service disruptions have we had this week? This is unbelievable!

Due to an incident involving a MAX train and auto at NE Holladay and Grand, MAX Blue, Green and Red Line trains are disrupted. Shuttle buses will transport riders between Rose Quarter and Lloyd Center stations. Riders should expect delays.

Lake Oswego citizens repeatedly are saying ‘no’ to streetcar

Citizen testimony at public hearings ran two to one against streetcar. Email correspondence to council ran approximately three to one against streetcar. The Citizen Budget Committee voted to eliminate any streetcar/Foothills funding. Now, a professional survey of Lake Oswego citizens identified that 82 percent of the citizens think other things are more important than Streetcar. This should be more than adequate information for the mayor and his majority on the council to listen to the citizens and understand that Lake Oswego does not want this streetcar.

A Hamilton bus driver was tailed and punched by an angry motorist, while another had threats made against his family by gang members who boarded his bus late at night and demanded to be taken where they wanted.

Blogger and bus driver Al Margulies reports: “An operator passed out due to a ‘sulfur smell.’” Well, yes and no, says TriMet. Here’s the email reply that spokeswoman Mary Fetsch sent in: “The operator was Cliff McGrady (note correct spelling). Riders told the operator of the smell. The operator said he did not smell the sulfur that was caused from overheating batteries. Passengers were off loaded onto another bus. The operator, with maintenance following, drove the bus back to the Merlo garage. He collapsed just outside the report area. Our safety staff believe the operator's collapse is unrelated to the sulfur smell.”

What kind of people apply to be a bus operator

This is from Puget Sound Operators blog, Jeff Welch, and it goes a long way in explaining why some of the people that end up working here are not exactly fit for the job:

but also because of the obvious lack of selling points: new part-time Operators are guaranteed no more than 2.5 hours per day (less than 13 hours per week), with no security regarding advancement, increases in hours, availability of desired schedule, etc. As one base chief once said to me – “What kind of profession attracts desperate people? Only desperate people would apply for the kind of job with this kind of working conditions, at least initially.” He was right. I was desperate.

We start at 12 an hour.You have to be desperate to start at 360 dollars a week at TriMet.

Bus didn't show up? Here's one possibility why..........

Due to a commercial power outage, MAX signals and switches are affected through the Rose Quarter and Union Station. Blue and Red Lines are on regular routes but are experiencing delays. Green and Yellow Line trains are looping on 5th and 6th avenues downtown and not crossing the Steel Bridge. On the eastside, Yellow Line trains are traveling between Expo Center and Rose Quarter and then east as a Green Line train to Clackamas Town Center. Shuttle buses are also transporting people from Rose Quarter to 5th and Glisan. Riders should expect delays.

Since this agency has two distinct operator functions one of which is clearly more difficult than the other Trimet should offer differential pay for the operators doing the more difficult work.


Driver that are forced to use old equipment and have the extra distracting burden of calling stops in addition to everything else that this position requires should receive additional monetary compensation.


This company has no problem finding $390,000 to hire spies to see if we who are driving the old antique equipment are calling the stops, but the company doesn't have the smarts to realize that for the same amount of money they could have equipped all the buses with automated technology.


Trimet calls itself a leader in technology, unfortunately for the transit division the technology has very little to do with operating a bus.

Witnessing the debacle of the WILLOW CREEK ART SUPPLIES CATASTROPHE of yesterday, it is obvious how pathetically unprepared and unmanageable this organization has become, god help us if there is ever a real emergency.

Driver stopped before the stop due to traffic. Then bitched at passenger for not walking up to him from actual stop.
To which our lovely pencil neck geeks sitting behind desks pretending they are important responded:
TriMet's reply: "Please report the operator of 5468 to Customer Service. Our operators are not supposed to encourage passengers to enter traffic.
Enter traffic? WTF? I think I know what the complainer was talking about, where the bus stops a few car lengths before the stop (like at a traffic light) because there are cars in the way waiting at the light, & so the driver waves the passengers forward to board so they don't have to stop twice. Which I think makes sense if the passengers are able to walk to the bus (I could see that not working if there's someone in a wheelchair, for example). But how did that get spun into the driver asking people to enter traffic?!

Each year TriMet’s Creative Services staff participates in a team building session to celebrate and support the concepts of usabililty. This year they competed in the Computer-Human Interaction Forum of Oregon (CHIFOO)’s 2011 Usability Hunt.  It’s part of World Usability Day that was founded in 2005 as an initiative of the Usability Professionals’ Association to ensure that services and products important to human life are easier to access and simpler to use. Each year, on the second Thursday of November, over 200 events are organized in over 43 countries around the world to raise awareness for the general public, and train professionals in the tools and issues central to good usability research, development and practice. TriMet had two team entries (TriMetUXers and TMCreates) in the local CHIFOO’s contest and team TriMetUXers took first place with 34 out of 38 points. See the results and read more here.

The 7.3-mile, $1.4 billion project will connect Portland State University in downtown Portland with southeast Portland, Milwaukie, and north Clackamas County.

It just so happens that I have reliable information about this operator, he is one of the most senior operators on the MAX line.
The explanation of the "headphones" is that they are EAR MUFFS.
It gets COLD in the driver compartments in the trains, so he wears them.
Notice how the complaint says "listening to music". That is a perfect example of how someone would EMBELLISH a complaint. How would anybody know what the person is listening to?

But above all, we see just how poisonous the public atmosphere is towards transit workers. The public just can't wait to 'inform' on us.

It's sickening what has happened to transit workers in this city, pathetic, just how much more can we take?

Union meeting synopsis

The following synopsis is what I heard at the meeting. As with any event which is recalled later from notes, there may be other perceptions of what happened. These are the most memorable events from today’s meeting. I don’t report anything specific since the union is so paranoid about the public/management getting a hold of any information.

I believe one of the reasons the union movement in this country is doing so poorly is because unions have indeed become a ‘secret society’. And that’s how the public view unions, as something more or less ‘devious’ that works in ‘secret’. If unions would actually include the public in the process it would be easier to get public support when dealing with issues that ultimately affect the public.

I’ve always had a tremendous respect for Jon Hunt after watching him conduct a union meeting.
Obviously a brilliant man, too bad things have gone so astray for him this past year.
He can function under the most extreme stress it appears, you would never know that the man was having such a bad couple of weeks watching him in action.

The first item was the issue of recording of meetings; they are very worried about being recorded, enough that Sandy Guengrich actually made a motion that all cell phones should be turned into Evette.
Motion failed something like 50-4.

First Transit is following the lead of Neil Macfarlane and lying about events that occur in its dispute with its unionized employees. The management over there refuses to return phone calls are among the unethical behavior being used in that dispute. An Unfair Labor Practice lawsuit is planned.

There were several arbitration's that resulted in members receiving full back pay.

The next picket at MacFarlanes house is scheduled for November 19th.

Jon did indeed serve the 4 days in jail, and he did that over the holiday. The news report that he did not was wrong.

Regarding Macfarlanes latest attempt to bully the union, Jon Hunt has sent a response over to Trimet about that. Again we have Macfarlane playing ‘bully boy’ and making decisions on his own without abiding by past practice and labor law. Nothing unusual about that, he is as anti union as Scott Walker although he pretends via internal posts that he is not. His actions betray his words.

Al Thomas got up and gave a speech in defense of Jon Hunt criticizing the members who are attacking him.

A member attacked Evette harshly, another member defended her.

The biggest surprise of the meeting was another PREFERRING OF CHARGES was filed against Jon Hunt.
Apparently this is based on his DUI conviction while on union business and using a union vehicle.

Jeff Ackerson made a passionate speech about honoring the process of charges and keeping it out of the management’s eye. This was in response to his witnessing the latest charges that ended up being published in the Oregonian being “left around tables” at the Merlo garage.

Jon sees nothing wrong with his trip to Romania, its in the "contract". I know there are other people that agree with that point of view.
We have all found out that a "contract" can indeed be violated (TRIMET?)
and just because something is in a contract why do you have to actually abide by that clause?

Personally I think Jon shows very bad judgement by going to Romania right now. It's of no real value obviously and another complete waste of tax payers money.
Evette got one up on Jon when he referred to "we made the decision" and she cut in and said "who made the decision?" Jon had to say "I made the decision".

C-TRAN CONDUCTING WAR AGAINST ITS DRIVERS

C-tran with 2 very disturbing terminations! Both were obviously not the drivers fault yet they were terminated! C-Tran drivers beware of your management!

In one case somebody in a mobility device rolled the device onto the lift, (battery was dead) the driver asked if he was ready, the person said yes, and the driver proceeded to bring up the lift. The guy fell backwards off the lift. They blamed it on the driver and terminated him.

In the other case a chair with attendant and woman on a walker boarded the bus. The attendant always puts the straps on the chair. The driver proceeds to leave the stop and a vehicle turns from the left lane into a right turn. Driver puts on the brakes and the woman with the walker "falls" (actually leans) into the wheelchair and ends up with a bruise. C-Tran fired the driver for not actually checking to see if the straps on the wheelchair were properly hooked. (Bizzare)
They would not pull the DVR for some reason.

Figures screwed up in 'secret shopper' evaluation

I keep looking at this 'secret rider' stuff and it looks like I got my math completely wrong.

The contract is for 5 years, not one year, so the rides are actually less than I thought.

The total contract was still for $297,500 which buys a heck of a lot of recording devices and a whole heap a bunch of call stop electronics at $200 each.

It's still bullshit no matter how you look at it!

TRIMET BULLSHIT-PART 3

They could use employees, and should. I am against First Transit, Vieola and all those for-profit companies. we can certainly better fund employees with taxpayer dollars instead of giving taxpayer dollars to overseas corporations.

Here at Metro, Ride Checks are done by uniformed supervisors, ADA checks are done by chiefs (person right below the person in charge of the base), who try to do it incognito, and dont have uniforms. All in all, our stuff is done by employees. Even that link I sent you some time ago about San Diego doing secret checks are at least employed by MTS, not a contract agency.

At TRIMET they have a whole department full of who knows how many Trainers!
This sort of evaluation should be done by our training department, not low paid workers for some profit making contractor!

Our average bus age is about 13.5 years. As a peer comparison, the average bus age at transit agencies similar to TriMet is 7.4 years. The interesting thing about our fleet averaging over 12 years is that for a 40' bus, 12 years is considered the service life (linked article is very long, but interesting). TRIMET BULLSHIT EXPOSED PART 2

This freaking company, which has neglected it bus fleet for so long, which pleads poverty and preaches service cuts, somehow finds $300,000 for a disposable "secret rider" program when that money could be spent on actually installing automated stop announcements.


I don't know about the rest of the people working here, but I am convinced this company is consciously using the ADA as a way to torture the drivers here.


They have all the money in the world to fix the problem, but yet they won't spend it?

LEADERSHIP CRISIS AT ATU 757 FORCING JEFF ACKERSON TO RECONSIDER RUNNING

Union members are concerned about the leadership crisis happening at our union and have been asking Jeff to reconsider his decision not to run.

After further discussions with his wife Jeff has agreed to take on the job of running a campaign and if members want him as their VP he will work tirelessly on our behalf

Those of us that have worked with Jeff as union rep know this guy is smart, tough, and has the guts to take on a job like this.

It's time we get some effective leadership at our union local.

These photos were taken in the Sunset Transit Center, but all of our break areas need a thorough cleaning and some paint.

Station Manager Greg Larson promises action on the conditions at this break room:
You are absolutely right about the break room at Sunset. I met with a facilities person recently at the breakroom to put together a proposal to improve the conditions there.
I am suggesting a cleanable wainscoting be applied to all the walls including in the restrooms. Paint the rest of the walls and ceilings and strip the floor and rewax. New chairs and two “lounge” type chairs as well.
I’ve been asking for something to be done there for quite awhile but I think action is finally on the horizon.

Milwaukie Mystery Train pushers never give up

It's insane the lengths to which the county commissioners in Clackamas County will go to bring the soul-killing, bankrupting, billion-dollar-plus Tri-Met MAX train to Milwaukie (pop. 21,000). Now that they can't create or expand any "urban renewal" district to pay their $25 million share toward the thing without a countywide public vote (which they'd probably lose), the commissioners are apparently just going to promise to pay out of property taxes, straight up, without the "urban renewal" ploy. They say they want to issue "full faith and credit" bonds, which means the county would have to pay from any available source. Translation: property taxes.
They're dressing up the p.r. on this by pointing out that the Clackamas Town Center "urban renewal" district is supposed to expire in 2013, and that will free up some property taxes that can be used to pay for the train bonds. Sounds nice, but it doesn't change the fact that those are taxes that can and should be spent on public safety and other essential county services.
Whatever the commissioners do to try to raise the money for MAX, they can bet there'll be a group trying to force a public referendum on it. It's pretty obvious that voters down that way have had enough Blumenauering, and they seem to be wising up so much that none of the commissioners' many maneuvers are working.
What they really need, of course, is a new set of commissioners.

THE CHRIS DAY INCIDENT UPDATE

Contact has finally been made between ATU757 attorney Susan Stoner and Chris Day’s attorney. It was a phone conversation followed up with a fax submitted to Chris’ attorney. The phone conversation addressed the concerns of a recording devise being used during meetings and was not clear if Chris was permitted to attend meetings or not. The fax submitted to Chris’ attorney presented Chris with required conditions to permit his return to union meetings. It also included conditions about Chris’ personal blog site. Chris and his attorney are both concerned about a conditional return and are keeping the option of getting an injunction available. Though the injunction is an added cost and is creating more monetary damages Chris is wanting to stay focused on the actual factual information and violations that had taken place. ATU757 has violated Federal Law and some Oregon torts upon their actions against Chris Day. Chris feels it is important for members to stay focused on the actual violations that is occurring and not allow attention to be distracted away from that focal point. Currently many members have personally voiced their displeasure of the actions that have occurred but are afraid to directly voice their feelings out loud to the officers. At this time it would be nice if other members would step forward in helping protect Chris’ rights as a member and make a clear statement to our union Staff and Officers that when one member is violated all members are violated. If ATU757 has legal grounds they must take actions that are within the law. If ATU757 is unable to produce factual evidence that supports their actions they must yield and correct the damages that has been done.

I hope you had a good Thanksgiving. I wanted to let you know that I tried to contact Susan Stoner today, which was more difficult than it should have been. Her # listed in the Oregon State Bar directory says it has been disconnected. No one answered the phone all afternoon at ATU’s local # for me to request her #. I finally, found a # listed to her and the voice message said it was hers, but she never called me back. Anyway, I’ll try again tomorrow.
If she answered I was going to introduce myself and tell her how I represent you. I would inform her that Jonathan’s actions where in violation of Federal Law, and probably constituted several Oregon civil torts as well. I would then ask her if you are officially barred from union meetings. Depending on how she responded to all of this, I would either request a meeting to internally work this out or tell her we will pursue your legal rights formally. So like I said, when I actually get to speak to an authority figure over there that is basically what I will say. If too much time goes by and it appears they are totally ignoring you/us, then we can discuss what the next steps will be.

Joe is wrong, I do NOT defend her past performance or her poor customer service skills.

But I do believe her that she did try to get the mom to come back on the bus.

In this particular instance she actually did something "reasonable" and I do believe her that she tried to get the mom back on the bus.


However, her past performance is why this happened to her; she has developed many enemies out here and this is what happens to drivers when they don't give the public the respect they deserve.

I need written clarification to do my job by the rules

This is another email sent over to the station manager:

I want you to know Mr Larson that as of today I will be following the exact procedure and rules regarding all my performance expectations at TRIMET.
I do need definitions however, since the rules require me to announce every time I turn, I need to know should the turn be announced before or after I make it, and if there is no stop where shall I pull over to make the audible microphone announcement?


For example I will announce by microphone (while bus is stopped and brake applied) that the first turn we will make today is "Lombard Street"


But then we turn onto "Canyon Road" and there is no stop until we are way down on canyon road, so where should the announcement be made?


Of course if I have the red light at the turn I can apply the brake and make the announcement that I am turning but that may cause me to miss the light and that is a 3 minute light.

STATION MANAGER FIRES BACK!

I don't get responses anymore from the management so this is rather impressive:

My memory has not failed me(why does he bother bringing up that I 'missed' the meeting then) and I believe we met on the 8th. We discussed the QAR ride of 10/21/11. Since then we’ve received another QAR report that took place 11/17/11 indicating no stops called. Both were random rides.(INTERESTING INDEED THAT THESE 'RANDOM RIDES' ARE SO CLOSE TOGETHER ISN'T IT? I'm sure he didn't send them, but there are plenty more managers around besides him.) I did not request them.
I did answer your email during our meeting and a video of yourself on your blog confirms that I did as does the second to last sentence in this email….”

This is very interesting, and I am trying to figure out what is going on here.
Regarding the allegation I made that he did not answer me and his response that he did answer me, I meant that he did not answer me in writing!

And now we have another "I called no stops" violation.
There is only one scenario that this occurs:
I KNOW EVERYBODY ON THE BUS AND WHERE THEY GET OFF!

I'm interested to see the full report, how many people were on the bus and what time did this happen?

See working for a company without ethics you get caught with your pants down because your using your brain instead of being a barking dog, which is what this management wants from us, BARK YOU DOGS BARK, it doesn't matter that the barking is of no use to anyone and you know for a fact that nobody actually needs a call stop.

So its one of my regulars that is the "spy".

I have a pretty good idea who it is, but managers need not worry, you will get your way now, I'll bark because you want me to, no problem. All they had to do was tell me that "Al, you need to be a barking dog and call out the stops even if it is obvious that nobody needs a call stop, we have spies who love love to bust our drivers for no particular reason."

I'm not quite ready to retire yet.

I want to say again: I HAVE NEVER HAD A REAL ADA COMPLAINT IN MY ENTIRE CAREER AT TRIMET, NOT ONE!

Ultimately TRIMET TRANSIT DISTRICT has failed the disabled, not  me and not other drivers.
They have been too busy building MAX to be bothered with getting the proper equipment in place for bus riders, including disabled bus riders.

How I intend to deal with TRIMET'S harassment

As of today, my entire approach to this job will be changed to following the exact letter of the regulations and rules.
I'm doing this because it has become obvious to me that I have been targeted for harassment.
I have been doing the job properly for 14 years, but this past year all of a sudden I am not doing the job properly.
This just happens to coincide with my very public criticism of our management and their complete lack of ethics.
Coincidence? I think not.
I am making copies of an explanation along with the two disciplinary letters to hand out to riders who may be wondering why the bus is not showing up on time anymore.

I am in receipt of your letter informing me of a “MANDATORY” meeting on November 29.
 I am unable to meet the time as requested; Jeff Ackerson will be contacting you about that.
Your letter states “you marked off sick during the last scheduled meeting”.
Your memory must be failing because on November 9 I was summoned to your office to discuss the releasing of the MAX crash video.  At that time we discussed the call stop problems.  I told you then that I have been calling the stops and have been doing so for years. You said I overreacted to the call stop violation letter. I then offered to pull the bus over at every single point where there is supposed to be a call stop, put on the parking brake and make the appropriate announcement. You said that was unnecessary.
