The Tri-Met chief executive obviously is a capital projects man, and not an operations man. Portland's transit agency is horribly insolvent, and so the capital projects are going to end soon. And now that that it's been outed as a menace to riders, pedestrians, and motorists alike -- exposed by the dowdy old Oregonian, no less -- McFarlane needs to step down.

Now keep on the pressure - why is TriMet operating 23 year old buses that have horrible maintenance and reliability records, when other transit agencies routinely replace their buses, following federal guidelines, at 12-15 years of age?

Hiding behind the Oregon Public Records law, which was created to aid in keeping government secrets they were able to obstruct Joe Rose from getting to the bottom of all this for months

But it takes a Joe Rose expose to bring up this safety problem?
In the real world heads would roll, but this is Trimet where there is no accountability so incompetence is rewarded.

We have the usual dishonesty being put forth by the Trimet people, attempting to link the union to the failed hours of service policy. The union has no responsibility for assigning work shifts. That falls strictly to the Trimet management.(Bruce Hansens comments regarding this story are here )The fact that Trimet management has chosen to abuse the hours of service policy is not the responsibility of the union, it falls squarely on the managements shoulders. The hours of service policy establishes the parameters which Trimet management must work under. It does not imply that the management must take full advantage of this policy. Management is free to hire the appropriate staffing but chooses to hire executives rather than drivers.

TIME TO CHANGE TRIMET GOVERNANCE VIA ORS 267.020

   267.020 Transfer of transit system to metropolitan service district; effect of transfer order. When a metropolitan service district organized under ORS chapter 268 functions in a mass transit district organized under ORS 267.010 to 267.390, the governing body of the metropolitan district may at any time order transfer of the transit system of the transit district to the metropolitan district, whereupon:
      (1) The governing body of the transit district shall transfer title to, and possession of, the transit system and of all books, records, files, documents, and other property of the transit district to the metropolitan district.
      (2) The metropolitan district shall be responsible for all the liabilities and obligations imposed upon or assumed by the transit district.
      (3) For purposes of mass transit the metropolitan district shall have all the rights, powers, privileges and immunities, and be subject to all the duties and obligations, of a mass transit district under ORS 267.010 to 267.390, insofar as they are consistent with ORS chapter 268.
      (4) The boundaries of the metropolitan district shall, for purposes of mass transit, be extended to encompass all the territory of the transit district.
      (5) The transit district shall be dissolved and the offices of its directors terminated. [1969 c.643 §40; 1997 c.833 §26]

TRIMET OBSTRUCTIONISM

There are many reasons why Mcfarlane should be fired but this this takes the cake.
 Intentionally trying to obstruct an investigation is a serious violation of public duty.
I hazard to say it borders on criminal behavior. 

Of course, McFarlane's statement that TriMet has long wanted to address the issue of operator fatigue run contrary to the agency's attitude about supplying The Oregonian with public records for its investigation.
At times, agency officials -- who charged the newspaper more than $3,750 for documents -- refused to run the newspaper's requests for information in its databases, arguing that such queries weren't required under state public records laws. When the newspaper then agreed to pay for the complete database of driver schedules from the past nine months, amounting to about 8,000 pages, TriMet's general counsel denied requests for the information to be supplied in a spreadsheet, text document or other format that could easily be moved into a searchable database. Instead, the agency insisted on converting the information into an unwieldy PDF format that required pain-staking copying and pasting into a database.
When The Oregonian attempted to get the complete record of the October 2011 MAX crash, TriMet denied the request, saying many of the documents were protected because they pertained to a personnel matter. After an appeal by The Oregonian, the Multnomah County District Attorney's Office sided with the newspaper, saying the information was so alarming that the public had a right to see it.

Neils Bullshit

 When you read through Neils latest Bullshit what you will see is there is no mention of structural improvements. Virtually every single full time run at Trimet mandates overtime. Not one word about scheduling and the mess they have made of operators lives with long split shift days and runs with out breaks. Not one word of the incompetence  of management for allowing  a shortage of drivers. Attempts to once again pass the buck on to the union are laughable. Mcfarlane has been such a miserable failure since they crowned him king that its embarrassing at this point that he remains General Manager.
