1. There is no expectation of privacy in public. Being on a public bus is...well, in public.
2. Anything transmitted via federally licensed radio spectrum is not private. There is no expectation of privacy over a radio. Doesn't matter if it's a licensed business frequency or CB Radio or FRS or television or AM/FM bands. If it's put on a public airwave it is public. Want privacy - don't use a radio. (If it were private, don't you think radio scanners would be illegal???)
