The defense, supported by character witnesses will be a pattern of harassment based on Lane's news gathering activities.
What was he excluded for?
ReplyDeleteI'm going with the "Use of District Transit System for Non-Transit Purposes" (28.15 (B) (1)).
Non transit purpose of course.
ReplyDeleteI'm almost certain we can get it overturned by showing the pattern of harassment that he has endured at the hands of trimet staff.
I'' be there as a witness along with a few other people who know Lane and what has been going on.
The first amendment also guarantees freedom of press, which is exactly what Lane was doing.

The amendment prohibits the making of any law respecting an establishment of religion, impeding the free exercise of religion, abridging the freedom of speech, infringing on the freedom of the press, interfering with the right to peaceably assemble or prohibiting the petitioning for a governmental redress of grievances.
ReplyDeleteOriginally, the First Amendment applied only to laws enacted by the Congress. However, starting with Gitlow v. New York, the Supreme Court has applied the First Amendment to each state. This was done through the Due Process Clause of the Fourteenth Amendment, by what is called the Incorporation Doctrine. The Court has also recognized a series of exceptions to provisions protecting the freedom of speech.
He has rights, the fact that he is not 'liked' is irrelevant.
