AUTO COLLIDES WITH WES
Yea the auto collided with WES, because the car driver thought he HAD A GREEN LIGHT! See for yourself! The design of that intersection definitely contributed to the crash
In reality, the car was not in the turn lane, which is regulated by a separate signal elsewhere. But the turn signal should have been put next to those green ones to make things clear.
Totally wrong Al. Let me SHOW YOU WHY. The car was turning. There is a left turn arrow. Take a look at the screenshot I took of the video at 25 seconds in. Sorry Al, Car screwed up here.
The driver of the car got a ticket for 'reckless driving' not illegal turn. He might want to consider fighting that in court.
The motorist should have been cited for ORS 811.265 (failure to obey traffic control device - turning left against a red signal), OSR 811.345 (Failure to use special left turn lane), ORS 811.455 (failure to stop for a railroad signal), and possibly ORS 166.116 (Interfering with public transportation).
The problem with the intersection is fairly minor:
1. Left turn signal mounted in a different location than other signals. There are still two separate left turn signals clearly visible and in the direction of view.
2. Lack of proper railroad crossing signal. Instead of using conventional railroad crossing signs, bells and gates, the wig-wag flasher is used in conjunction with the traffic signal. This can be confusing to motorists.
Ultimately, it comes down to the motorist who was lost and confused, and made a left hand turn incorrectly (out of the through lane). It just so happened that a WES train was going down the track at the same time. Confused motorists are my pet peeve - if you don't know what you're doing, find a safe place to park - and STOP. Don't drive erratically, don't slow down, don't keep going - just pull over and stop.
As for "reckless", here's the state's definition: "means that a person is aware of and consciously disregards a substantial and unjustifiable risk that the result will occur or that the circumstance exists. The risk must be of such nature and degree that disregard thereof constitutes a gross deviation from the standard of care that a reasonable person would observe in the situation" (ORS 161.085) So, given that she made an unsafe turn out of the wrong lane, went against not one but TWO separate warning devices (the red left turn signal and the railroad signal)...I'd say she was reckless as well.

Disagree Lane, you're the one that is wrong. The driver saw a green light because the intersection is so badly designed.

The article says the driver was ticketed for careless driving and not reckless driving.
