If the person gets to keep the pass, that means there's no real penalty, and people who plan on continuing to ride or know someone who does will have no incentive to pay until they're forced to.
Even if they don't get to keep the pass they'll still come out ahead if they don't get checked at least once a month.
Community service doesn't cost money for someone who doesn't have any.
