Well the answer is because THEY HAVE ALREADY LOST THE HEALTH CARE RULING!
ELRB HAS RULED that Trimet violated the law with its offer and the health care provisions were thrown out.
So the concept that TRIMET is setting the stage for legislative action, either through a public referendum or action by the legislator is a sound theory.

I dare TriMet to declare chapter 9.
That would allow TriMet to do whatever it wants with the contracts. Heck, it could legally just eliminate ALL benefits...you get paid and that's it. No paid time off, no vacation pay, no healthcare, no nothing.
Of course...there's one pesky little detail about Chapter 9.
No more light rail.
