HOURS OF SERVICE ROBBERY

Brothers and Sisters,
To those who drive (extra board especially), this is some much needed information on what is coming down the pike. Our union choose to not talk about these issues at the last board meeting, thus leaving us in the dark about things that members DID NOT agree to, and did not sign off on, in ANY type of ratification of solidarity with other members. As most drivers know that this (SO) called agreement is AMBIGUOUS at best and allows management to write the rules as they see fit; while our lives are now being torn apart on a weekly basis. Though none of our leadership was there to rebut anything they are claiming, our Sister Sandra was there to watch the meeting and gave testimony ("off the cuff" I might add) before the Board concerning the HOS: CLICK HERE!
At least we had her on "our-side," explaining the impact of these changes and how they harm front-line workers daily.  My question is, "WHY AREN'T MEMBERS GETTING PAID FOR THEIR WORK???" So I looked for "any" law that the company might be in a violation of, for not paying members what they owe. Under our current system, the company has records of our "log-in and log-outs," so, a violation is still a violation; due to the fact is they have to pay members, time-slip or not. Under the Fair Labor Standards Act (see attached), the company is in violation of the law. The law says, "An employer cannot sit back and accept the benefits of an employee’s work without considering the time spent to be hours worked. Merely making a rule against such work is not enough. The employer has the power to enforce the rule and must make every effort to do so." Under this law (which circumvents CBA-Collective Bargaining Agreements); they are stealing from members by taking their actual time they worked, instead giving them scheduled time. A clear violation.  Another question, "are they doing this on every body who does not turn in a time slip????"  Is the new $35 million dollar INIT not properly recording "log-ins and log-outs????"
