What I really object too

An accident just occurred on the east side where a car blew right through a stop sign and smashed into the side of a bus.
There were two witnesses to this event in two separate vehicles, one of which was a police officer.
The accident has nothing to do with the Trimet operator, completely non avoidable, yet this operator is going in for a drug test!
WHY?

I believe is it DOT/FTA regulations. If there are injuries and/or lots of damage, regardless of fault.

Technically, ORS 813.100 applies to ALL licensed drivers, so I'd just ask the cop to drug test the other driver too. (This is in addition to the federal law for commercial drivers.) If they refuse, their license is suspended on the spot.

I got into an argument with a Tigard cop about this when I was in a wreck about six years ago. I saw the other driver (who turned left in front of me without warning) moving open beer containers from the passenger compartment to the trunk before the cop showed up. He accused me of telling him how to do his job. I explained he's welcome to tell my dad that...oh, wait, my dad was killed by a drunk driver in 1985.

He backed down, the supervising Sergeant showed up...in the end her insurance company paid out quite a bit of money.
