Employee filed this action against Employer, alleging that his exposure to diesel exhaust fumes while employed by Employer caused him to develop cancer. Employee subsequently died, and his wife (Petitioner) was substituted as the plaintiff. Petitioner amended the complaint to allege that Employee's death was a result of his exposure to diesel exhaust fumes.
