What Is Wrong With This Picture?
The Oregon Employment Relation Board Issued the Following Order:
“TriMet will also make the bargaining unit employees whole for any losses incurred due to its unlawful conduct, including reimbursing employees for . . .contributions toward premium costs they were required to pay; and payment of any medical expenses they incurred because of the unlawful conduct.”
TriMet Successfully Argued to the Appeals Court When Asking for a Stay Pending Appeal:
“TriMet would be required to pay employee health insurance premium contributions and medical expenses incurred by hundreds of TriMet employees during a specific period of time . . .”
On 8/8/13 TriMet’s “InsideInfo” Stated the Following:
“TriMet will begin recalculating premiums paid by union employees that are reimbursable...”
Notice what is Missing? That’s right . . .
ERB’s order: “and payment of any medical expenses”
TriMet’s Claim to the Appeals Court: “and medical expenses incurred by hundreds of TriMet employees”
Bottom Line: TriMet owes for premiums and the amounts employees and retirees paid over and above what they would have paid in 2010 for medical expenses. This includes, but is not limited to, money paid for excess deductibles, excess prescription co-pays, excess doctor co-pays, and a number of other medical expenses that cost you more in 2011-12 than they would have in 2010.
