Here's a good primer on how lawyers can impeach your testimony so you can maybe prepare for it:

Thanks HH!

That is indeed helpful but I have not participated in any sworn testimony as of now so I can't imagine what they are up to.

If they use my blog material against me I have over 30,000 posts how can I be expected to remember everything I may have said

Actually I do know what they are up to. This move by the prosecution has complicated the defense in regards to using me as their witness.

I was supposed to be the star witness for the defense this screwed that up

adverse witness

n. a witness in a trial who is found by the judge to be adverse to the position of the party whose attorney is questioning the witness, even though the attorney called the witness to testify on behalf of his/her client. When the attorney calling the witness finds that answers are contrary to the legal position of his/her client or the witness becomes openly antagonistic, the attorney may request the judge to declare the witness to be "adverse" or "hostile." If the judge declares the witness to be adverse (i.e. hostile) then the attorney may ask "leading" questions which suggest answers or are challenging to the testimony just as on cross examination of a witness who has testified for the opposition.

First, what does it mean to impeach a witness?

Generally, to impeach a witness is to undermine the source of information as opposed to undermining the content of the testimony. The concept is pretty simple really.

The cool thing about impeaching a witness is that it’s a tactic that we’ve been using since we were little kids to win arguments. When someone accused you of doing something on the playground, you probably figured out the fastest way to defend your innocence was to attack the source of the accusation.

You are on the right track... Also where is the ACLU to assist Mr Jensen?

Al M said...

ACLU doesn't take individual criminal cases, only cases that affect groups as in class actions

Although it is true that the ACLU generally takes cases that affect the civil liberties or civil rights of large numbers, it will represent individuals if it deems that there is substantial infringement that could involve others in similar circumstances.

I would urge Lane or an advocate (Al?) to at least run it by the ACLU to see what they say. I don't think they will represent him in his criminal trial but maybe as he sues TriMet for false arrest and breach of his civil rights?

Right if he actually wins this case you'll have more than ACLU to pick from
